Redundancy consulataion

I am on notice of redundancy which ends, end of August. I was given the letter 45 days before the end date.

I am now on holiday and will not return until after the end Aug.

I did raise to HR several times (verbally) that I was concerned I hadn't heard anything and I am on holiday end of August.

I received at letter to ask me for my consultation whilst I am on holiday :mad:

I am after advice what is best for me to do? Should I arrange childcare and go in on my holiday? I would rather not I promised my son who is struggling with his issues at the moment that I would spend all the holiday with him.

Will I be penalised if I refuse to go in on my holiday which will mean the 45 deadline will have passed.

    You can decline if you wish. But that's your consultation - you have given it up voluntarily. But unless they can reschedule (have you asked?) before your holiday, then that is the end of the line for you, I would guess. A consultation generally takes only an hour or so.

    What would have happened if I had booked to go away abroad? It would not be possible for me to go in, would I lose my right to a consolation then?

    My holiday was booked before the letters even came out about the redundancy so it not as if I have booked a holiday in this period on purpose.

    As it happens I did arrange to go out for the day with my son and his friend on the day I have been asked in, am I expected to cancel that :( two kids are going to be very disappointed. :(

    Ask to reschedule, seems perfectly reasonable to me.

    Also they may be willing to do it over the phone, worth asking.

    As suggested - phone? Email? But speak to the employer first. I assume you haven't. But the bottom line is very simple - the timescale doesn't extend because you aren't there. So you must find a way of communicating with them or accept that you won't be able to discuss it.

    If you can't make it in then do it over the phone. I could not attend a meeting during my consultation and we arranged a phone call and they sent out any paperwork by recorded mail.

    Unfortunately in life things come up unexpectedly that causes us inconveniences and ruin the best laid plans. I'm afraid nothing will hold up the process of possible redundancy and its best to get as much information ASAP so you can make informed decisions.

    No I haven't spoke to them as I only got the letter this morning, I wont be able to speak to anyone until Monday. I am just trying to find out where I stand before I speak to them.

    Yes you are correct as an adult I understand this, unfortunately my child who most likely has ASD and ADHA does not :( All the holidays have been extremely difficult with him and I have repeatedly promised him I will be spending these two weeks with him, he is not going to understand the fact I now have to leave him :( even if it is only for a short amount of time.

    No I know where I stand I will just have to make a decision if to go (much better for me) or give up my consultation (much better for my son).

    I must admit to being confused by this.

    I though by law I am entiled to a consultation. I appreciate they have offered me one BUT I am on holiday so in effect they are cancelling my holiday asking me to go into work. To cancel holiday I believe they have to give as much notice as the holiday is, therefore they need to give me two weeks notice after which I will be back on that date?

    Not your only options though surely? I'd be asking for a reschedule or to do it by phone.

    You make a strong argument that your kid comes first which is good as this will help in your decision making when you have a clear priority.

    So what is the problem with explaining this to your employer and arranging a phone call and have the consultation that way?
