Parking charge but broken down

Hi,

I have read these threads with interest, and have now come to a point where I need some answers.
This is about Parking Eye.

Unfortunately I did not find this thread until after I started down the appeal process, so I shall go back to the beginning.
I was at Morrisons car park, Gosport, it has 2 hours free parking. I went into the shop, was visiting my daughter, and to buy some lunch, returned to my car about 30mins later only to find my keys inside my car.
I phoned the breakdown company who came out, but due to it being a busy day (saturday) they took over two hours, as I was not deemed a priority job. My complete time in the car park, was close to 3hours, albeit I could not move the car, as I had no keys.
I got the penalty charge through the post from Parking Eye, appealed, sent proof from the breakdown company to Parking Eye, they rejected it.
So appealed to POPLA, they got all the evidence from Parking Eye (although the photos of the signs from Parking eye were 2 years old), I sent my evidence, stating that short of carrying a 1.5ton car out of the car park, I could only wait for the breakdown company to turn up.
POPLA rejected the appeal, saying that I was parked there longer than the time allowed, which was never in dispute, the fact that I could not move the car was the point of the appeal.
I have now contacted Morrisons, who cannot do anything as it has gone through POPLA.

I am now at a point where I either just ignore this, and see what happens, or pay, the latter I don't want to do as this was nothing I could control.
I would appreciate some help and guidance, also if there are any letter templates I can send.

    Morrisons are telling big fat porkies if they say they can't do anything. They employ Parking Eye, they are the boss not the other way around. Email Morrisons ceo demanding a cancellation.

    Parking Eye actually issued a PARKING Charge Notice, not a PENALTY charge notice

    one thing that PE cannot do is issue a PENALTY Charge Notice , they leave that to the police and councils (and not on private land)

    let them issue an MCOL and argue it out in court, let a judge decide

    T remember reading about a similar case going to court and the judgs gave the PPC a wigging and threw the case out. I believe Parking Prankster blogged it.
    You never know how far you can go until you go too far.

    I contacted their customer service department.
    I am quite prepared to take it all the way to court, as I believe it is completely unfair.

    Does anyone know the email contact for the CEO office at Morrisons?

    I have now just contact Mr David Potts CEO of Morrisons so shall see what response I get from him.

    I once broke down in a Morrison's car park, and for a time considered leaving my vehicle there overnight. The customer service desk was happy to waive the parking charge.
    I guess in that situation, a person doesn't always think of the parking conditions.

    Did you spend some of that extra time in their cafe ? If so, the CEO might be interested.
