    Should I respond or was referring to the reference number in my email enough?

    Also, my access to this forum keeps getting blocked, says admin blocked my IP address, happened a few times now, is there something I’m doing wrong?

    Respond except for the DOB and phone number, tell them that is EXCESSIVE data harvesting and has no impact on the case.

  • So things have escalated slightly since my last posts.
    I am yet to hear from the ICO.
    BW legal didn't respond to my SAR and ive had no further response about my GDPR objection email from Britannia or BW Legal
    The biggest shock/disappointment is that I now have a Claim Form issued from the County Court in Northampton from BW Legal.
    To say I am absolutely confused and out of my depth right now is an understatement. Never dealt with anything like this so not sure what to do next.
    Any advice appreciated.

    This gives you a complete run down of the entire court process
    Go there now, and the FIRST thing you do is follow the instructions on ACKNOWLEDGING the claim
    Tell us when you have done this

    THEN tell us the DATE OF ISSUE on your claim form.

    No worrying, no stressing. 90% of posters have neveer dealt with a county court claim, but they are nothing to stress about.

    Why are you sending a SAR to BW? Theyre not going to have everything, the PPC will have everything. Send THEM a SAR, as well.

    Had a read of post Number 2, I cant open the link on how to acknowledge the service, not sure if its the drop box website that is restricted at work so will have a read of that tonight via mobile. I can open the link to a very similar case to mine, which I will definitely be basing my defence reply on.


    I sent an SAR to BW Legal on the advise of Coupon Mad who I would regard as the top pro on here and has been a massive help so definitely going with any instruction they give, I have already sent an SAR to Britannia which they replied to.


    Date on my letter is 1st November, so by my maths that gives me to at least the 19th to reply based on the day of service being taken 5 days after the issue date, right?

    If you are saying you have a Claim with an Issue Date of 1st November, you have until Tuesday 20th November to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

    Having done the AoS, you then have until 4pm on Tuesday 4th December 2018 to file your Defence.

    Over three weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If it is not, then chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
