    I'm trying to get as many of us together as I can but there not taking it seriously, they still think if you ignore all correspondence it will just go away!!
  • Hi, the court letters looked like photo copies so we thought they was fake but then one of the girls phoned court, and they confirmed there was a case for the number she had provided. She wouldn't give her name or anything so they wouldn't give her anymore details than that.

    They are bunching the tickets up into months, and applying to court for the total tickets received that month.
    I think the most they have asked for in one go has been £6000
    The rest are just for £200/£300 or individual tickets at £120
    A few of the girls have got in excess of 150 tickets so the 18k is each girls total cost if they take them for every ticket.
    How does she expect to win if she got 150 tickets in the same car park?! That said she simply has to defend as a judgment for that amount will surely leave her bankrupt! What a complete mess!
    If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.

    I think when the claim gets into the thousands it might be time to get proper legal advice and a solicitor to defend them in court. It will cost but could save a lot of money if they win.

    Has anybody been to court yet to defend a claim because if court papers are ignored and the claim isn't defended the judgement will go to the claimant (CP Plus) by default. Then if the judgement that they must pay the claimant is also ignored it will result in a CCJ against them.
    Who are the legal firm/solicitors CP Plus are using to issue the claims?

    Unfortunately Private Parking tickets should never be ignored and if tackled properly in the first place I'm sure all these tickets could have been trashed at the POPLA stage.

    Fortunately for me I don't have many tickets to fight, well not as many as the other people do, as I had a dispensation up until January this year so I'll carry on appealing the tickets that I can appeal.

    I'll try and find out what solicitor cp are using and get back to you!

    The OP for that claim should be posting on MSE and Pepipoo as well as trying to garner support from any "group " set up. I think any group could be disadvantaged to some extent if the court decides to hear the cases in a similar style to the Indigo cases.

    Meadow Hall used to have PCM infesting their car parks.

    CP Plus do not rely on the provisions of POFA for keeper liability.

    It's not the staff car park where they are being ticketed. It's the regular public shopping centre car parks which are all round the centre and have 12,000 spaces, plenty. These are free and have no time limit for parking.

    The centre are forbidding staff from using them and hitting them with a £80 ticket for parking where anyone but them can park. Parking Services / DRP are then bunging on another £40.

    The issue here is that CP Plus must have proof that it was a worker at the centre that parked the car and was 'on duty' at the time. It could have been the workers partner, spouse, relative or friend driving the car and visiting the centre. The burden of proof surely must be on CP Plus to provide evidence that identified the driver as a staff member., Which I would say is impossible unless the CP Plus attendant saw the car park up knew the driver was a staff member and going to work, not just shopping. They would have to file a witness statement saying that.
  • It's the shopping centre car park we got the tickets in not the staff car park.
    some of our tickets are from when we were shopping and on day off.
