    Go to the papers anyway. Just say you will not have pictures etc as you fear for your job. Come on, they do this all the time!

    Contact the BMPA - NOT the BPA, the bMpa :) - and see about getting help. This CANNOT be allowed.
  • I've appealed my other NTK That went over the days of 29- 57 and they have refused to send me a POPLA code for all 4 of them.

    Did you appeal these PCN's to CP Plus (appeals@cp-plus.co.uk), or was it to Parking Collection Services (PCS aka Debt Recovery Plus)?
    Those replies are from PCS and mention the Independent Appeals Service.

    Reply and say:

    No, I decline your invitation to name the driver and want my POPLA codes please, as registered keeper of the car I am entitled to that appeal and will have no hesitation in reporting CP Plus and PCS to the DVLA, the BPA, the local press and to Trading Standards for treating staff like some sort of cash-cow.
    Because of the huge scale of this 'scam' the media would be interested. I'm sure The Sheffield Star would run a story which would then be picked up by the national press.

    The Daily Mail are always keen on stories about private parking companies.

    I also think the member of parliament for the area in which Meadowhall is situated should be contacted and asked to help.

    She is Gill Furniss M.P.

    I agree, the staff need to publicise this and get the message out to others there NEVER to say who was driving, and to come here to learn how to appeal them all to POPLA carefully, not writing their own version.

    Telling the local MP is a MUST. Urgent!

    Coupon Mad, Mr Parkinson is collection manager for Parking Collection Services AKA Debt Recovery Plus. Would it not be better to not contact them at all but email CP Plus directly?

    In these Meadowhall cases CP Plus issue the NTD (windscreen ticket) but then PCS seem to send out the NTK's on CP Plus headed paper on their behalf. Also adding on another £40 to the Parking charge while they are at it, which is contrary to the BPA's COP.

    If the OP PinkLady is sure that these NTK's were sent outside the relevant period for delivering a NTK after a NTD had been given, (day +29 to day +57) as prescribed by the BPA and POFA. Then might I suggest she emails CP Plus saying something along the lines of ;

    I decline your invitation to the name the driver of the vehicle on each of the occasions these PCN's were issued and there is no obligation for me to do so.

    Furthermore as a member of the British Parking Association's 'Approved Operator Scheme', you have agreed to comply with and adhere to the BPA's Code of Practice.

    I would like to draw your attention to the following paragraph from the Code of Practice.

    20.2 Schedule 4 of POFA 2012 creates the new legal basis to claim unpaid parking charges from vehicle keepers and hirers. As long as the strict conditions of Schedule 4 are met, you may claim payment from the keeper or the hirer of the vehicle rather than from the driver. To do this you need to follow the procedures set out in the Schedule.

    And from Schedule 4, POFA 2102 ;

    Paragraph 4,
    (1) The creditor has the right to recover any unpaid parking charges from the keeper of the vehicle.
    (2) The right under this paragraph applies only if:
    (a) the conditions specified in paragraphs 5, 6, 11 and 12 (so far as applicable) are met.


    Paragraph 6,
    (1) The second condition is that the creditor (or a person acting for or on behalf of the creditor):
    (a) has given a notice to driver in accordance with paragraph 7, followed by a notice to keeper in accordance with paragraph 8


    Paragraph 8,
    (1) A notice which is to be relied on as a notice to keeper for the purposes of paragraph 6(1)(a) is given in accordance with this paragraph if the following requirements are met.

    (4) The notice must be given by:
    (a) handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or
    (b) sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.
    (5) The relevant period for the purposes of sub-paragraph (4) is the period of 28 days following the period of 28 days beginning with the day after that on which the notice to driver was given.


    Therefore as the PCN's listed above were not delivered to me within the relevant period, you do not have the right to transfer the liability for the unpaid parking charges from the driver to myself, the keeper.

    I require that you CP Plus delete or remove all of my personal data relating to these PCN's from your files and systems. To keep, process or pass on to 3rd parties any such data would be a breach of the Data Protection Act 1998.

  • Hi, looking back on my emails it looks like I've sent these to enquires@parkingcsl.co.uk

    It's where I sent my first appeal too and they gave me the POPLA code so thought it was the right place.

    Not if the NTK was issued by PCS and tells people to appeal to PCS - surely the OP should have had POPLA codes.

  • Oh no! 3 out of the 4 are Notice of liability not NTK I didn't notice the difference.

    Only too late for POPLA codes, not too late to ignore them. Come back if court claims are issued, and we will help defend these. What did the NTK look like, was it POFA compliant?

    It only states they will pass the case to debt collectors (big wow, you will get some more letters - so what, really?!).
