Which is the servient land and which the dominant? If a deed of release is completed - is this on the servient land?0
-
I have a question for the LR representative.
We purchased our current house in England in May 2011.
However the sale was not registered with the Land Registry for five years so it is showing as last sold on Right Move and other sites that obtain their data from the LR in May 2016.
Our conveyancing Solicitor did not complete the necessary paperwork and we did not discover this for five years. The process was then completed but the sale date was recorded as May 2016 and not May 2011.
Is it possible to get the Land Registry records corrected to reflect the actual sale date in 2011?
Thanks.0 -

The former is the land that is subject to the right/easement for example whilst the dominant has the benefit. I'd expect to see the Deed of release registered alongside the actual noting of the easement/right“Official Company Representative

It's the date of the deed itself that is added to the shared data so the sale date should be that. So if they dated the Transfer May 2016 then that's the date used“Official Company Representative

Hiya, a question for LR
We bought a house 3y ago built 1999, we bought from the people who bought as new... our solicitor didn!!!8217;t inform us, but there is a restrictive covenant saying no extensions without permission of the building company or their surveyor (not named)
The building company was dissolved in 2011, does the covenant still stand?
TIA!0 -
Hi, I was hoping for help with a little problem.
I completed on a lease extension back in November 2017 but have just found it has not yet been registered at the Land Registry. My solicitor advises that HMLR had a query on the original application which was not answered in time and so a new application had to be made which was done on 10 May 2018.
I assumed it would take 3-4 months from November 2017 and so waited until March 2018 to market the property and I have now accepted an offer on it. I really do not want to lose the sale and have heard that I can ask the Solicitor to apply to expedite with HMLR but the application would have to be accepted.
Was wondering if having a buyer is always grounds for expedition and also I can see that once expedited registration can be done in 2-3 weeks but how long does it take for an application to be accepted.
Any help would be very much appreciated.
Many thanks.0 -

saskia297 restrictive covenants tend to bind the land/property indefinitely so it is important to read and understand the covenanting clause and specific covenants to confirm which land they benefit.
For example covenants are often imposed for the benefit of the 'estate'development' involved so once that is split up and sold you have multiple landowners with the benefit of the covenants“Official Company Representative

If you have a confirmed buyer then the solicitor can submit those details and ask us to consider expedition. That request would normally be considered within 24/48 hours.
If it is expedited then it is usually considered within 10 working days.
Key points to consider are
Solicitor should be aware of what is needed and how to request expedition
Completion of the process will be reliant on their having resolved the previous point of course
If it is not in order, there are prior applications with priority or we need to contact third parties for any reason then it can still be delayed.
But if they don't request expedition then it is likely to be several weeks before it is considered“Official Company Representative
