Ok, so if you want to be 100% sure that it is unregistered then it's form SIM and a search of the index map you need for a guaranteed result“Official Company Representative

Hi there,
I'm about 3 months into a house move and my solicitor has told me that there is a problem with the deeds, my buyers solicitor has pointed out that a clause referenced in the deed of covenant doesn't match up with a clause in the estate rent charge deed and possibly shouldnt have been registered with the LR when I bought the house in 2006. She further tells me that she has written to the LR about this and is waiting for a response.
My buyer is needing to move into rented and it wouldn't surprise me if the chain collapsed. If my deeds are wrong surely the LR will only be able be able to confirm this and a deed of rectification (?) will be required regardless, are you able to advise me how long this will take to sort out?
I am rather stressed with the whole process.
Many thanks.
Lamby - it doesn't read like something that is 'simple' and as you suggest if there is an error and the deeds have been registered we can't just alter them
How long a reply takes will depend on the details provided and whether the paper files are required. If 2006 then I suspect they will be.
What's the title number involved please so I can see if I can find the enquiry?“Official Company Representative

violettasomerset wrote: »Hello, we sold our old house and bought our new one at the start of February and have not yet received any paperwork about the transfer with the Land Registry (both properties were previously registered). However, both the sold prices have been listed on Rightmove for a few weeks which suggests that the transfer has gone through. Our solicitor says they haven't yet received anything from LR - is this likely to be due to a delay with the LR issuing the paperwork back to them, or just our solicitors dragging their feet? Thanks, V.
violettasomerset - if both were already registered then I can't see why it would take this long. The average is 8 working days.
Do you know the title number involved and if so what is it?“Official Company Representative

maimee_magic wrote: »Thanks for your reply. We only want to able to use my CGT allowance as well as my wife's when she sells the property and was looking at the most cost effective way of doing this. Does the Declaration of Trust need to be registered at the Land Registry?
No - the existance and impact of the Dec of T can be registered, usually as a form A restriction, but we don't register the Dec itself“Official Company Representative

Thank you for the quick reply. The title number that we've purchased is AV11xxxx, I don't know about the old house but we're less worried about that one!!0 -

Many thanks - enquiry received 5th June. Paper files are needed to check what details we have to facilitate a reply. Hopefully that will be this week so we will have to hang on to see what that reply states“Official Company Representative

Many thanks - that application (Transfer dated 18th Feb 2018) was submitted on 19th March and completed same day. Solicitor would have been informed by post“Official Company Representative

Thanks Land Registry. I had been given the impression that this enquiry had been raised some weeks before the 05/06, clearly something I will need to discuss further with my solicitor !0

That was quick! (both your response and the transfer) Sounds like I will need to speak to my solicitor and get them to pull their finger out. Many thanks for your help, V.0
