    Hello, 

    Any update on the current waiting time for registration of a new property, which I believe is being done via a Transfer of Part? 

    We bought our (new-build) house last year - completed on 14 November 2019. Still no registration. I think it's a transfer of part, because it was a small builder who bought a plot then built two houses on it, one for themselves and one to sell (which we bought).

    Really bugging me that the paperwork hasn't gone through. And unfortunately the solicitor we used has a bizarre process where they don't send us all the paperwork for our house until the registration is complete, so we have no copy documents at all related to the house, almost a year on (obviously this part isn't Land Reg's fault!).

    Anyone can apply so no reason why your sister cannot submit the application on her own. 
    Similarly if she is the named and sole executor in the probate then evidence of her identity is covered by the probate. 
    It would not be a voluntary registration as in order to become the legal owner she needs to assent it to herself, that assent is a transfer of legal ownership and therefore triggers the need to register

    Unfortunately we still have a backlog of this type of work so the length of time to date is invariably simply ‘waiting’ time from receipt to our considering it 
    Nothing to worry about as you bought and completed the purchase and the application protects that. Of course such a long wait might be concerning for some but hopefully your solicitor explained the current delays and not to worry about the wait time for you. 
    Hopefully it will be considered and completed shortly and when it is we will notify your solicitor and in turn they will share that detail with you including a copy of the completed registration

    How long are TR1 forms taking to process at Land Registry Service please? We have been gifted a property and the Solicitors have sent over the completed TR1 forms this week. The Solicitor have warned it could take months for the LRS to update the record. However, on the LRS Government website, the register update time frames are showing as 13 working days.
    Confused! 
    If it’s a register update re the Transfer then the current wait time is around 4-5 weeks 
    The 13 day average you are referencing is from several months ago so should be ignored. Timescales are very much out of kilter due to impact of Covid 19 
    Unsure why solicitor has warned it could ‘take months’ so worth confirming with them that it is a register update rather than a register create. The former is an update to an existing title whilst the latter is the creation of a new title, which will wait several months with a backlog of that type of work

    Thank you.  My sister is a named executor on the probate, but she isn't the only one.  My brother and I are also executors.  Am I right to infer that this means it's still ok for her to make the application on her own but she needs to provide evidence of her identity?

    I was wondering if anyone can help with some wording in my title deeds. 

    I currently have my house/garden then an access road behind (unsure who this belongs to and doesn’t show up on the map search) then my other garden/land. 

    Behind this land backs onto another garden from a house on another street. 

    This is the wording from my title deeds

    The land tinted blue on the filed plan is subject to the following rights reserved by a Conveyance thereof dated 5 March 1945 made between (1) Mary Wilson (Vendor) and (2) Ronald Wilson (Purchaser):-  "RESERVING to the Vendor her successors in title and assigns owner or owners for the time being of the said property known as "Name Removed" a right of footway Four feet six inches wide (in common with the Purchaser) over the strip of land shown and coloured brown on the said plan and leading into the said occupation road".

    Its hard to make out from the plan which this brown strip is but that’s not really an issue. 

    I can’t quite work out what it actually means, Strangely the ‘vendor’ and ‘purchaser’ have the same surname. It reads that owners of said house have a right of way over this strip but the wording of ‘owner or owners for the time being’ suggests it was temporary? 

    It’s not in dispute or anything, the land doesn’t have any gate and the wall that is up has probably been there for at least 20+ years. I’m just a little curious.

    Hi, I need to send some documents to Land registry. They want some pre-registration deeds which I know they already have. Do I need to send these and must they be certified?

    Anyone can lodge the application. 
    The key is the probate. If you are all named then it’s usual that you all have to transfer it and anyone named in the probate as executor then doesn’t need to have their identity verified

    If we’ve asked for them yes. If they are originals then that’s what we need too. 
    If they are plain copies and uncertified they may not be acceptable. All depends what we want them for
