mr_jma said:RE:Change from tenants in common to joint tenants, form ST5 HELP!Hi hope you can help!
I've obtained a declaration of trust template and filled in form RX3 but can see no help with ST5 which is statement of truth to cancel a form A restriction. Part 3 asks "Explain what has happened to the beneficial interest protected by the restriction. (Provide accurate and relevant information). You should include certified copies of any documents showing this.".
I have wrote "The proprietors (our names here) have re-declared their trusts and the tenancy in common has come to an end. Within the declaration of trust dated (todays date) the proprietors have declared that their beneficial interst in the Property be held as beneficial joint tenants.
Is the correct response?Our online guidance explains what’s required and your ST 5 has to state the facts.What you appear to be lacking is the confirmation of the final bullet points for example“Official Company Representative
I am the official company representative of Land Registry. MSE has given permission for me to post in response to queries about the company, so that I can help solve issues. You can see my name on the companies with permission to post list. I am not allowed to tout for business at all. If you believe I am please report it to forumteam@moneysavingexpert.com This does NOT imply any form of approval of my company or its products by MSE"0 -
Hi, yes I'm submitting a certified copy of the declaration of trust. I thought the facts in the bullet points were covered by part 6 and signing the ST5? Are you saying these points needs to be written as a statement of fact as well?

The declaration of trust covers the last 3 points.

Hi Land_RegistryI live in Northumberland (North-East) and am interested in buying a plot of land for a self build. I have signed up to the local council's self build register however that has a waiting list of ~3 years and there is very little information regarding the process and it seems like best case I would get a small plot on a developer site and nothing rural/nature surrounding.Is it unrealistic for me to be able to purchase a plot of land with no house building permission and then either get approved for a single home or get it approved as a self build plot (so that others can build there as well via self build scheme)?A quick example could be this, as it has a variety of Woodland and Grassland: https://www.zoopla.co.uk/for-sale/details/55263491Naturally if I was going to attempt this I would get a much smaller plot, maybe a few acres and for a much smaller cost which may swing things in my favour (if it's possible).As it stands it seems that all cards are stacked against individuals trying to achieve this. Companies and developers are land banking and are in cahoots with government/councils to release swathes for developers to build concrete jungles.If you have any tips or advice it would be greatly appreciated! Trying to find this sort of information is like gold dust.

@penguineater
That has nothing to do with the Land Registry, they only record title ownership. It's up to your local council and their planning policy what will or won't get permission.1 -
HM Land Registry,
Having been told my request to expedite my application has been granted, how long would a expedition take under current conditions if no problems arise.0 -

An application for what?0 -
Apologies if this has been answered elsewhere. I am my father's sole executor and probate was granted in April. The house is not registered but I have all the documentation since it was built. I'm in the process of selling my house and will move into my father's house. The money from the sale of my house will give my brothers their share of the house value. Is it straightforward to just instruct a solicitor to register the house?0
