    Hi, I purchased a house almost 12 months ago and am still waiting for the title deeds, I have been told there is a delay,(by a few months) but it has been almost 12 months now and I would like to have these documents and forget about the issue as I am leaving the country soon. When am I likely to get them please?
  • Hi Land Registry, hoping you can help.  My mum left a share of her and her partners home to my sister and I.  My aunts name was added to the land registry as she is the other trustee (mums partner is the other one).  Mums partners name was already on the land registry as he owns majority share. 

    My sister has been paid her share and mums partner wants to pay me and remove my aunts name from the land registry.  But my aunt is refusing to sign the form to remove her name of the land registry.  Mums partners solicitor has advised him not to pay me until her name can be removed.  

    Is it possible for mums partner to complete the RX3 (I think is the right form?) and get her name of?  He can provide proof of my sister being paid and if this route is possible he will pay me and will include that proof with the form to you.  Just wondered if this was possible?  So mums partner and I can both move on with our lives. 
    B: Proprietorship Register
    Title absolute
    1. 07.07.2000 this parts states mums partners name and the address of the property and my aunts name and her address. 
    The restriction states: 2. 07.07.2000 No disposition by a sole proprietor of the land (not being a trust corporation) under which capital money arises is to be registered except under an order of the Registrar or of the Court.”
    Any help really appreciated as this has been going on for quite sometime and would like to find a way to settle this. Thanks in advance.

    I'm trying to find recent sale prices in Woolwich. I know properties were sold even as far back as 6 months ago but they're not appearing on your site. 
    They are new build properties, but how long should they take to appear in the public register?

    Title plans show the general boundaries for any registered extent. They are not updated when the buildings around them or within the red lines change in size or shape. That is because the registered extent does not alter.
    So if the property you are buying is fully within the red outline then there is nothing to change or update or query. 
    However if the changes have lead to encroachment in some way on the ownership of the property being sold or vice versa then there is an issue to be resolved by the seller. But that won't usually be resolve by simply updating the OS detail on the title plan

    Certain types of application are subject to quite lengthy delays at present. For example if you bought a new build then there can be a delay of several months between receipt by us and registration. A tear would be extreme but I suspect that includes the time from completion to actual lodgement with us.
    Your solicitor should be able to confirm the date of lodgement and the title number/case reference for you. If it was lodged in May/June last year then that would tie in with the backlog/delay with us. But remember you completed and your application protects your priority so unless there is an urgency now, such as an onward sale or expiring mortgage offer then you may have to wait a little longer for it to be completed

    An RX3 will only help to cancel the restriction. It would not remove her name for example. The form RX3 along with supporting evidence would be used to show that the restriction was no longer required. However your post refers to the actual named legal owners so until they transfer the legal ownership to a sole name for example then the RX3 does not really come into play

    The prices would appear on our site fairly quickly after they had been lodged with us. There can be exclusions though 
    The data would not appear on third party websites for at least 1 if not 2 months later

    Thanks for the reply. The title plan does show a green box that indicates a boundary has been removed from the title. The property is fully within what would be the new red box however the rear boundary is shown as a straight line when in reality the boundary is angled, as mentioned this is shown correctly on OS map. If the seller asks for this be corrected what would be the process they need to follow and how long would it take?

    A green box, namely land edged and numbered X in green means part of the registered title has been removed, usually after it has been transferred, from the title. That removal will have been based on the document submitted at the time 
    As mentioned we register the general boundary so you may find that a straight line on the plan is angled on the ground so we don't just straighten or realign the red line for example. 
    So if you/the seller assert that the registered extent is wrong that it all depends on whether the 'extra' land is registered or not and what can be done. If the land is significant in size then it may take quite a while to resolve, especially if we have to contact the adjoining and affected registered owners
    Based solely on what you have posted it is impossible to offer any timescale. It could be very quick, if we simply state that such a difference is covered by the general boundary aspect I have mentioned.
    If it's just an enquiry then that could also be very quick but if they have made an application to alter/correct the details then that could take much longer.
    So I would suggest asking them to confirm exactly what they have done with your concerns and ascertain whether they have simply enquired or made an application to update the register. And if the latter ask them to clarify how long they think it might take

    Another question.  Can my mums partner submit the RX3 (with evidence) before my aunts name Is removed?  I assume that my aunt will have to sign paperwork agreeing to remove her name from the deeds?  But I’m thinking that she will have no legal right to refuse if the trust is settled and the land registry have seen evidence and have processed the RX3.  The only reason her name is on there is to protect the trust.  Once the trust is legally seen as complete my aunt has to sign!?   Just trying to come up with a way of getting this done and finished as my mum wanted and her partner can move on with his life.
