  • We had an offer accepted on a property on the 12th January, all seemed to be going well. We are first time buyers so not 100% certain on the normal process. The property is being sold after probate but that has all been completed fine. I was told 23rd Jan that the deeds were with our lenders, I did not hear anything until the following week when I chased our solicitors for an update, I was then informed the deeds had been lost so to expect 'several weeks' delays. A week passed still no news so I contacted our solicitor again, he couldn't give any more info than previously. So I phoned the estate agent on the 6th Feb, to be told that the house had not been registered so was currently with LR for first registration. I asked for a timeline and no one can be more specific than 'a few weeks' Can anyone shed some light on how long we can expect this to take?

    I just downloaded the title register from the land registery website and the house is registered to the local council, and the address is 'land on xxxx road' should I be concerned or is this fairly standard for a house that has never been registered?

    It's either registered or not so you'll need to make sure on that score as we don't register 'houses' as such but we register the land. Once a house is built and a postal address given then that would normally be how it is described on the land register.

    If the property (land and house) is unregistered then a first registration takes on average around 32 working days

    Not to sure what you mean by 'adopting land' but if you mean claiming it then have a read of our PGs 4 and 5 and seek legal advice

  • Hi LR sorry to be a pain but our sellers solicitors have told us they have now requested for VA16AD7 to be expedited.

    Would you mind checking if this has been accepted please, and the ETA on a turn around if it has?

    Normal turnaround for an expedited application is 10 days subject to requisitions.

    My partner and I are due to exchange contracts on our first house this Wednesday 27th Feb 2019, BUT WE HAVE JUST FOUND OUT THERE IS NO RIGHT OF WAY TO GET TO THE PROPERTY!

    It is a house in a row of five terraces with front access to all houses via a road entering onto the land of number 1 and then on to 2 (ours), 3, 4 and 5. There is also a rear access lane which seems to be unadopted.

    The title register for number 1 speaks of it's right to use both front and rear roads as well as mentioning the right of the 4 other houses to use them also. This right is also present on the title register for 4 and 5 but does not appear in the root of title for ours! (though it does appear in historical deeds to 'our' house)

    Our house is unregistered and we are hoping that since our right is expressed in the title register of the servant land and others that land registry will agree to add the ROW to our title. If not...are we not landlocked? Should we pull out?

    I applied for copy of a Lease on OC2.

    LR cashed the £7 cheque on 7 Feb but nothing received either post or email.

    How long should this take? Do I need to chase them?
  • Hi all,

    Got a question re the boundary to my property. We’ve recently moved in and got hold of the title deed. On it it shows land that sits outside of the current wall that is owned by us.

    My question is, is there anything stopping us pushing the wall out to adopt this land into our garden?

    I can post a picture if it’s needed.

    Any help would be much appreciated!

    Practice guide 1: section 4.3.5.2 (I'm probably still too new to post links) deals with easements on first registration, form FR1.
    If your title deeds don't show an easement then applying with details of the easements showing on the other properties may get them added to yours.
