    Our solicitor started a application on Friday 1st Feb and expedite the application.
    We receive a letter on Friday 8th stating we need a ordnance surveyor survey to up date your files in order to complete the application which can take up to 2 weeks.
    We are in urgent need of this sorting other wise the sale is going to fall through.
    Are you able to advise if it will be quicker than this and how long does it take once the surveyor has been out for the application being complete and notified to my solicitor in order to get the ball rolling with our sellers solicitor to sort contracts ?
    This is causing immense stress

    The survey is done by OS on our behalf and will be done asap but within 2 weeks.
    Once the survey result is back it is usually considered within a few days but timings then depend on what it reveals and also if any other checks need to be made. For example if you are claiming land we may need to carry out wider checks which will also take time which can't be accelerated.

    Not trying to add to your stress but you should discuss next steps with your conveyancer so as to understand the process inc the wider conveyancing issues involved

    We have just put our leasehold flat on the market, having extended our lease on it in October. However, our solicitor has just told us that we cannot sell it without having the documents back from the Land Registry.


    They have said this can take up to 9 months. Is there any way to expedite this? If we had a buyer and the lease extension was delaying the transaction, would the land registry prioritise our lease extension? And if they would, how quickly would it happen?

    Basically it’s a tiny bit of our front garden, when we brought the property we had indemnity insurance and that was it !
    Now we are having all these issues over a tiny bit of land causing massive delays in knowing whether it’s as simple as getting it registered in our name so we can complete the sale of our house.
    Our solicitor hasn’t made us asware that there could be more to it, he makes it sound as simple as getting it registered in our name then it’s happy days !
    For something that’s meant to be expedited isn’t moving very fast and no doubt we are paying for this service !

    Your solicitor can ask us to expedite it and send evidence to confirm onward sale. If we can expedite it then it's normally considered within 2 weeks. Everything then hinges on whether it's in order of course.

    9 months is a very extreme estimation. The current average is nearer 3 months but it's only an average

    Expedition is not a chargeable service.

    And you are claiming ownership so we are required to carry out certain checks to minimise the risks that someone else may come forward and prove that it's legally theirs.

    You insured against that risk when you bought but others may not be happy to do the same hence insisting you register it now.

    If the claim stacks up; the survey supports it; and the checks are all positive then that's as simple as you can get. But such things take time to complete

    Firstly, entry C2 of LA898100 explains how the title is subject to the rights granted by the 1990 Deed so it’s the Deed and it’s wording you need to be reading for those rights. Not the registered title under which it is filed, namely LA619346. So I am unclear why you/your solicitor are mixing in title LA619346 when the reference to it is simply to confirm where the copy Deed we have is filed.

    Secondly, the 4th schedule and plan you refer to are from the same 1990 Deed. The references to ‘blue land’ in that Deed are in relation to the colouring on the Deed plan only.
    The title plan refers to blue land for a very different reason so you should not be mixing the two.

    I'd recommend going back to your solicitor to understand what it is you have signed and why as I can;t see why you are in the loop you suggest unless there is more to it, which only your solicitor can advise on/confirm

    Spoke to solicitor today, they said it was around the basis that the transfer document/title plan is missing for the land on LA660095, therefore because it contains unknown restrictions/covenants at the time of transfer (What the indemnity insurance is covering us for), we can't build on it. However I asked again, how the blue bit is on the current title plan for LA898100 if it's come from a none existent transfer doc; to which he refer back to the missing transfer doc for LA660095 and until that exists he can't answer the question (the infinite loop).

    It was submitted on the 11th Feb. Does not include a request to expedite. Average timescale is 51 working days
