    If your complaint to FOS was as incoherent as your ramblings here then I'm not surprised that your complaint failed.

    You really need to work out exactly which act you are claiming under. You seem very confused about the differences between SoGA, DSRs, CCRs and CRA.

    Your purchase was made under SoGA as it was in August 2015 before CRA came in to force, so any claim you make has to be done under SoGA. It would also have initially been covered by CCRs if purchased at a distance but the cancellation you talk of merely refers to your right to examine the item as you would in a shop and return it (thus cancelling your order) if you didn't want it. It does not cover faulty goods, that is what SoGA was in place for and now replaced with CRA.

    The FOS would have had all the information from both sides to base their decision on.

    The CAB and FOS helpline would only have had the information you provided to them. Without being rude, you don't relay the information in a manner that is exactly easy to follow, so I believe it would have been quite easy for confusion to arise.

    Same with, it won't make any difference that the product is faulty.

    If they suppose to be impartial then all information should matter and to determine if the product is faulty.

    Very confused - That's why the timeline I mentioned previously would help.

    From what I gather though, you had the item for 2 months and it became faulty. You wanted to reject the item however the company went out of business.

    You then sent it to the manufacturer who confirmed the item is faulty, however you didn't want them to repair it, so got them to send it back faulty. Whilst this was going on you raised a claim with the credit card?

    Why didn't you just let the manufacturer repair it?

    If what I am reading for your rather cluttered posts is that you sent them an email to start a claim after 2 months, you don't have the right to demand a refund, you can request one but it is at the retailer's discretion as to which remedy they take.

    In this case, though I'm sure someone with a higher post count else can clarify I believe the CC company would only have to put you back to where you would have been prior to the complaint which is with either a working product or a refund, but again, this would be their discretion.

    If that is the case then it seems they offered the repair but you refused it, so the FOS are correct there are no violations of section 75, you just don't like the outcome.
