    Ahh, I see - I missed that - apologies ..


    However i wont apologise for having an opinion and im not trying to state legal precedents here so stop looking for an arguement.


    I have been in court rooms many times where one person is saying one thing and the other person is saying something different (aka your word against mine).


    I dont watch much telly


    I would consider calling my opinion "nonsense" to be the start of the disruption of this thread


    However, I will leave it to you now to go ahead and solve this issue for the OP ;)

    Yes, I have proof, direct bank transfer of the money directly leaving my account, and going straight into his account. And I have various messages, for example me saying 'I will loan you the money, but you must pay be back' ... and him replying 'I will I promise'. I know his address, place of work, phone number, bank details. I know everything about him ... except for the important issue, that is a lying idiot.

    Thank you for the extra information. The issue date for mcol claim is 22nd July, so he'll have until the 5th August to respond.....

    I have even written to his mother!! Hoping she might be able to talk sense into him!!

    And yes, lesson learnt the very hard way, I'm an idiot as much as he is.

    Then you are covered, but I wouldn't expect him to pay you the money. Start working on how you are going to collect the CCJ - does he work, if so - where, does he own anything etc.

    And OP means original poster, so you in this case ;)

    I would expect you would have more luck with his mother than the court route though in this case.
    (If she's reasonable person that is)


    He's likely to be much more bothered about the consequences of messing with mum that the result of any court hearing :D

    Can you explain what collecting a ccj means? He in a self employed window fitter, but works for a company as a sub contractor. So quite traceable. He doesn't own anything. He told me he rented a room in a house with a few other guys ... but after googling him and his parents for addresses, it seems it's the same address, so he lives at mummy and daddy's house ... I'm rolling my eyes! ... so I guess it's in his parents best interest for him to start paying me back, or they may get debt collectors knocking at their door? Or is that just on TV??

    The County Court have an enforcement team, who frankly, aren't up to much.


    If a CCJ isn't enough to get the guy to pay, then you escalate it to the High Court. This costs a fee, along with costs per visit.


    Yes, as I said in my previous post, they're the guys who you see on TV.


    However, the fact that he lives with his parents may work against you.


    Even if they let the HCEO team in, if they prove that the belongings in the house are not the debtors, they can't collect anything. If they don't let them in, they cannot force entry and still can't collect the debt, nor take any cars that belong to the parents.


    Does the guy have his own car? It must be free of finance like PCP etc to be collectable to pay this debt in the case of non payment.


    It may be worth using the threat of the CCJ to get the parents to make the guy see sense. or of course, they may side with him, in which case, litigate away!

    CCJ - county court judgement, which is a court order that X owes Y money. This is the thing you've applied at mcol for.And read the link I've previously posted about enforcing a judgement, as this is what you will have to do in order to collect anything if he refuses to pay on his own.

    This may include bailifs knocking at his current residency address to take goods, but you will have to pay for that service. But that doesn't mean that you should be involving his parents directly, as this is a debt between you and him, no one else. Also if he is being paid officially, not under teh table, then you should be able to collect against his wages. And if he is paid under the table, well, HMRC would love to hear about it.

    Ok. So assuming he'll go hide under his bed like the coward he is, I wait until the 5th august, and if nothing, I click the next button and take it further. I can't let him get away with it. Not when I know where he is and know he can afford to pay me!! X

    With the evidence... I'd get him on Judge Rinder... publicly shame him.

    Going to court would be private.
    On the telly is an "up yours matey" gesture.

    The bonus of this route is that, years after he's been shamed/named on the telly .... they keep rolling repeats for years and years ..... and years....
