So ignore the early payment discount?
What are you thinking of doing with the 'early payment discount'?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This whole industry works by bribery, lies, fake tickets, threats, bullying, doctoring photos etc.
All the above have been reported on here time and time again.
The early payment reduction is a bribe to get you to pay up a still ridiculous amount of money to bullies to make you give up without a fight, so they can move on to the next victim at minimal cost to them.0 -
ok so in other words they should ignore that then.
So, guess the driver should sit and wait to see if they reply now0 -
The markings apparently are indication of an old tree planter which had been filled in with bricks, with grey bricks in the center where your car would be, and lighter reddish brickwork around the perimeter where a car would go, it was not a disabled space, or a loading bay.
The tree planter probably looked quite nice in its day, but has since been removed, at some cost. Either it was so unsightly / dangerous that it had to be removed ; or it was removed to provide another parking space, and hence increase revenue for the business. Increased revenue by more shopping is fine, increased revenue by parking charges isn't ; if the rectangles looked enough like normal parking bays to deceive people, I'd say that's fraud ( exposing someone to risk of loss ).
It would be interesting to know how much money has been made from these "fake" parking areas ; and hence how generally they are perceived to be true bays ; an outline of coloured bricks is a common alternative to painted lines. If they really didn't want people to park there, a bit of white paint would say "No Parking", "Loading only", "HM The Queen & Prince Philip", "CEO & mistress" etc. Non-grey bricks could have been used to write the words / symbol.0 -
So it was a marked out, car-sized rectangle, very similar to the parking bays ; but the parking company insists it wasn't a parking bay. Do the owners of the retail park, state that those areas are / are not parking bays ; or is it the parking company which has decided ?

seem to recall PP blogged about those false bays , now go to the planning department and get site of the plans that were accepted for the site to be built , read how many bays were stipulated , then start walking the site , very easy for a parking co to introduce "honey traps" as a form of steady incomeSave a Rachael

They will probably fight the cause that it was a marked bay, and there was no clear indication that it wasnt a parking space.

They do not know about the retail carpark owners, if they find out do they contact them and ask?
There is no other markings around in stipulating "no parking"0 -
it is defined by the planning department , not by a trumped up ex clamper who is short of ready cashSave a Rachael

If the OP is supposedly in a "contract" with the parking company, and agrees to pay a huge sum for parking not in a bay ; I think the onus should be on the parking company to demonstrate that it was clearly marked to the contrary. See :

Does Google have an aerial / Streetview photo showing a car there ? If there is enough evidence of drivers not being ticketed / warned off ; that might be a breach of the site's planning permission.0
