    It's about 'intent'. If you take goods while knowing you don't have the means to pay, that isn't borrowing. That's theft. If you fill up and then find you don't have your wallet with you, that's an unfortunate mishap.

    The reality is that it is very difficult to prove intent so it's an honourable draw, you are both right, it is a criminal act but the chances of it being criminally prosecuted are vanishingly small.

    I still think the most likely punishment is not getting paid before the payments get processed and getting walloped by bank charges.

    Theft only occurs when there is the intention of permanently depriving the other of the property. Leaving your details with an intent to pay later is clearly demonstrating there is no intent to permanently deprive.

    So if you've used all the fuel that has been taken, then that fuel isn't coming back. It's gone. Permanently. I'm not saying a prosecution is likely. But it is possible.

    If payment fails it will be when the machine is authorising the card in the first place, before fuel is dispensed! If declined this conversation is moot since you can only do pay cashier option. If accepted it'll take you in to unauthorised overdraft if no money when it eventually comes out.
  • Its not worth complining to Tesco, maybe you should of done something after realising the money hadnt left your account.
    Does anyone know why Tesco pay at pump has started to not accept my Lloyds Bank Visa Debit at their pay at pump can only use in kiosk (if its open)

    Has the magnetic strip been damaged? That can stop it working in pay at the pump as it uses the magnetic strip for authorisation.
