    The notice period can start before the appeal. The appeal hearing may even take place after the end of the notice period.

    Edit: If the OP was reinstated, she should be able to argue that the 'holiday' was actually a period of suspension, and therefore she would still be entitled to take the holiday at another time.

    The length of employment really is key here.

    That is strange, because ACAS advised me the opposite when I was in your position. That's the problem with any advice service, if you speak to a different person you may get a different answer. Alternatively, things may have changed, my situation was a few years ago.

    As you have only been there eleven months I imagine ACAS have also advised you that your rights are very limited? That is probably why your employer has done it now and not in a months time? x
