Bespoke greenhouse, incorrect size - what are our rights?
Comments
-
We have an invoice that states a length of 124" and we need a base of 10'4". (I've been saying 10'6" but I meant 10'4"). The greenhouse is 127".
It's like pulling teach with you.
When did you get the invoice and is there any disclaimer about sizes?
I'll also ask you again did you see one before you ordered?0 -

And I'll ignore it again. I know what you're like on these forums and don't want to get dragged into an argument.0 -
What information did they supply?Do you have any documentation from the seller outlining your cancellation rights?
Also, as you bought via Ebay and used Paypal, have you considered using either Ebay's or Paypal's buyer protection schemes?
I've no idea whether they would be successful, but there are plenty of people on the Ebay board who would know.0 -

This is a classic case of buyers remorse and you're now looking for a way out.
You're on a consumer rights board - part of consumer rights (the consumer rights act specifically) is that goods must be of satisfactory quality. What is of satisfactory quality can depend - it takes account of things like price paid. And given the price paid, I'd be expecting something a lot better than what OP has described.
Buyers remorse is when you buy something, get exactly what you ordered but aren't happy. Not when you are led to believe you will be getting goods of a certain standard and the reality doesn't match up.You keep using that word. Given he bought it unseen maybe it is satisfactory quality and his expectations were too high.0 -

Actually, the quality of the greenhouse is fine - below the standard we were expecting and that the listing suggested, but they're things that can be repaired/filled/adjusted.
Our issue is that the contract we signed when we paid the deposit stated a greenhouse 124" in length. It also said we needed to build a base 124" long (which we did at a cost of around £1,200). So the fact the greenhouse is 127" long is the reason we're unhappy. The seller is saying they build them longer on purpose, but this clearly isn't true - just look at the photos on their listing where the bases are larger than the greenhouse.
We've asked the seller to replace it with one that is the length we ordered, come and repair it and refund us £250 to adjust the base or just give us a 50% refund so we can adjust the base and carry out the work needed to improve it.
They don't seem to want to replace it and have instead offered us a 25% refund OR said they'll give us a full refund if we return the greenhouse to them. We didn't suggest either of these options! We still want a greenhouse - just one that is the size they specified.
But this is not our fault - we followed our end of the contract (paid in full, built a base 124" long) so surely it is up to them to collect the greenhouse if we decide to terminate? We're seeking legal advice to confirm.0 -
So take the £1250 discount and use that to rectify the base.0

...is the correct answer to the problem!0 -
I have a similar problem at the moment with a garage door. It's a slightly different design to the photo and the website is saying we have to return them before we get a refund they've said they agree its different. I think they need to collect it?
What happened with the greenhouse deaston?0
