Faulty Swan kettle retro pyramid

Hi there.
I bought a Swan retro pyramid kettle blue

Swan replaced it as it had been 2 years.
The issue was that it was leaking everywhere when filled up.

I'm now on my 2nd kettle from then. Which after 11 months is doing the same thing.

They have said I can't have ankther, or refund etc as 'Whilst I understand the disappointment that this has caused you it is with regret to advise that I am unable to take this matter any further. The reason for this is, you are outside of the 2 year guarantee period as this item does come with a 2 year guarantee from the original date of purchase which was back in November 2014. It is advised in the user manual that the guarantee of this product is from the original date of purchase'

Now after looking at reviews online quite a few people are having the same leak problem. Obviously this is not not fault. It's a manufacturer issue.

Does anyone know where I stand? On amazon the Swan retro Pyramid kettle

    Did you buy this kettle direct from Swan?
    If not then the manufacturer owes you nothing more than that offered by their guarantee.

    You do however have a statutory right to seek a remedy from whoever sold the thing to you for up to six years following the sale.

    Be aware though that the seller can ask you to prove that the kettle had a fault at the time of the sale.

    It is likely that the remedy would be a partial refund to take account of the nearly three years use you have had.

    How much did it cost when new?
    Do you still have any proof of purchase?

    I bought it from online 3 years ago. I have the proof still. I forwarded that the Swan 2 years ago. They replaced it, gave me another kettle. I'm now 11 months down the line using this one and the same has happened again (leaking everywhere at the same position). The replacement was sent by Swan. I had emails between us and i still have them.

    Because it's at fault for the 2nd time and it came directly from Swan I thought maybe it's them to sort out the issue.

    As you bought it direct from Swan, then you have the right to seek a remedy from them for up to six years from the sale.

    The Sale of Goods Act tells us that once it has been confirmed that the fault is inherent, e.g. the leaking is due to a manufacturing defect rather than any misuse or fair wear and tear, then they must provide a remedy in a timely manner and without causing significant inconvenience.

    Any guarantee is in addition to your statutory rights and cannot override or remove your statutory rights.

    I would suggest you point out to Swan that you are not seeking a remedy under their guarantee but under The Sale of Goods Act.

    OP does not state whom he bought it from only it was on line and receipt was forwarded to Swan to claim under guarantee and the replacement came from Swan.

    So OP where did you buy it from and how much did you pay?

    3 years use out a 20 quid kettle, time to get over it and move on. Some battles are just not worth fighting, especially for the pallty refund you would be entitled too.

    The OP also says "it came directly from Swan", although on re-reading I do concede that may be the second kettle that came directly from Swan.

    Op, please confirm who you purchased the original kettle from.

    You still haven't answered the question. Did you buy the original kettle directly from Swan?

  • The 1st one was bought from eBay, £35 I think. I have the proof of purchase In which I sent to Swan at the time. Then Swan sent me out a replacement for the faulty one as it had been 2 years.

    Hooe that makes sence
