disagreement at work over using the phone while in the car, anyone know whos right?

FWIW, our company policy is not to use the mobile phone at all if you are in a works vehicle, either handset or bluetooth. We managed for years without them, we can do without them whilst driving.0

I wasnt using mine but I did touch it while it was sitting in centre console and was seen by a cop standing on the pavement0 -
No, operating a phone would be. I would not be committing an offence if, as I often do, move my phone from my jeans pocket and placing it on to the passenger seat. It's not an offence to touch your phone, it's an offence to use it.
Either you are wrong or the traffic cop that spoke to me is wrong0 -

No I didnt and I got a ticket, and I had not picked up the phone
I did argue that I wasnt using it, he said I had the option of going to court, I chose not to contest, maybe I would have got off, but as I was offered a mobile phone awareness course I didnt contest it0
