Cancellations

Hi I'm hoping someone can give some advice - my husband cancelled his contract with the Carphone Wharehouse by letter in July for when his contract ran out in August. We cancelled the direct debit after the last payment and thought that was it. In august he recieved another bill althought the phone had not been used. When he rang up and told them he had cancelled the girl on the end of the phone apologised and said oh yes I can see that I'll cancel the bill.

A few weeks later after another letter chasing payment, he rang back to which the carphone wharehouse denied all knowledge of the previous call or recieving the letter! They said they would look into it and ring back as all calls are recorded.After that I think he spoke to them again and thought it was all sorted out.

This morning another bill has arrived asking for 2 months payment!! This is despite the phone not being used for the last 3 months (he'd taken out another contract)

Is there any regulatory body we can complain to about this? Any advice would be greatly appreciated

    Did you send the cancellation letter by recorded delivery?

    Have you checked on the RM website that it was delivered?

    Did you ask for disconnection code from CPW before you wrote to them?

    No unfortunately we didn't send it recorded delivery as I cancelled my contract with them at the end of my contract with no problems. And no he has never been given a disconnection code - should they? They had said they would disconnect it when he spoke to them the first time.

  • I would suggest you write a polite letter to them, including a copy of your previous letter ("create" this if you have to), and send it recorded. If you have no response, write to head office with copies of all preceding letters... and carry on until you get the result you want. Then if they do want to take you to court you have the evidence that you need to have their claim against you dismissed.

    Make sure you keep a record of everything and do everything in writing - NO phone calls!

    Do you have personal legal cover with your home insurance? That might help too...
