Threats from china after complaint

Options
Hi all, I hope someone can help me please as I'm annoy upset. My partner and I set up a small business last year and we decided to get a mascot. Our company colour is purple and after so much searching came across "Spot Sound" supposedly based in France. They did have a uk website but this particular purple bear mascot was only made on the French site. I went ahead and ordered. Red flag raised when tracking said shipped from beijing. Opened the package to see quite a disappointing mascot. Not too dissimilar from photos but quality not as expected. As it's customised with our logo we can't send back. I asked for partial refund but no reply. I asked for a new suit as head, hands and feet were acceptable it www just the body we were really unhappy with.

After a reply of "mascot is cool for this price :)" I said I would be leaving a bad review and that I was not happy.

The next email I got was: "I like the style 😉

Anyways you didnt find a way to give you our answer that you poste a bad review.

40 pounds for the fan is not cheap you have transport cost / taxes to pay..

Have a good time with your kids, we can post also bad things for your reputation..."

This worries me that they involve our children.

What do I do please? Just ignore and accept I made a bad decision? My OH is really cross with me that I've wasted hundreds of pounds. He also mistakenly bought some uniform off a scam site last year but managed to get the money back as the shirts never turned up. I didn't blame him though, mistakes do happen. I just feel stupid now.
Can I get the money back at all? I'm worried this company can turn nasty. 2 people got in touch on instagram to say spot sound stole their photos and used as their own as well.
Thank you

The chances of getting your money back from a Chinese company are slim to none.

Chalk it up to experience and do a little research about companies you do business with in future.

    how are they threatening you?

You stated you were going to leave bad review on them and they say they could post bad review on you.
Have a good time with your kids,
is not a threat on your kids

b2b so you have no consumer rights.

I cant understand why go to such a site when these are UK reputable mascot providers

Sounds like a business to business transaction and Consumer Rights will not apply. What does their Terms and Conditions say? Frankly as the Company involved seems to be based in China it's probably going to be best to put it down to a somewhat expensive experience and move on.

Due to all the spelling mistakes on their site, it is clear it is not a UK site

they are registered as a limited company, but they list a correspondence address in London that is used by 3,101 companies, but their name is not listed

Why did you go with this site? Even if you didn't do any research into their customer service you surely read their web-site. If you are genuinely setting up a business you need to be much more on the ball or you'll be scammed again.

And what has your boyfriend getting his money back from a completely different problem got to do with this? Am I missing something? Do you not think he should be annoyed at the money you've wasted?

But if they're registered as a UK company then they ARE a UK site for all intents & purposes.

And according to the T&C's on their french site, you are contracting with the LTD company registered at the address you mentioned.

OP, how did you pay for the items? If you paid by debit card, try a chargeback for goods not as described. If you paid by credit card, you may still be able to attempt a section 75 claim (despite being called the consumer credit act, individual is defined as including sole traders, small partnerships & unincorporated businesses).
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

With all due respect, British business are hardly better. I am British but currently working in China on contract as an engineer. I once thought like you did - but am now seeing things differently.

I have had my possessions from a UK based middleman courier, Parcelmonkey undelivered, returned back to the UK (allegedly) but not returned back to the sender address 4 months and counting. This is a BRITISH company (in a developed country) that has a bad online reputation, but still manages to continue trading.

China is a developing country. The UK is not - therefore higher expectations should be expected.

The only consistently good service I can vouch for in the UK are the likes of John Lewis, Marks & Spencers. Small businesses are a hit and miss for the most part.
