Has this story been posted previously under a different forum member name? It sounds familiar.

    Hmmm...

I'm REALLY not convinced you're helping your argument one tiny bit with that.
  • Crap barrister and legal cover, perhaps... But I'm not seeing a 'SCAM' here.

    Thanks to everybody who commented.

For those who have time and who want to learn a bit more about the decision making of Jurors and Judges , the influence of emotions and cognitive biases can distort their decisions .Even if the case is sound with evidence , well presented with good solicitors , cases can still be dismissed. It is a huge subject , it could consume months of your time.

    There are studies on the internet the following on google;

Emotion in the Behavior and Decision Making of Jurors and Judges

the emotional juror fordham law review

    The Emotionally Intelligent Judge:

    Cognitive Biases
Make Judges & Juries Believe Weird Things

    Unintentional Bias in Court

So just beware that even a good case can thrown out.

With your obvious love of Google research, I'm surprised you didn't represent yourself, it seems you think you would have been able to do a better job.

    Yes, it can.

But the only relevant strength of a case is not what you think is available to be presented in court, but what actually IS presented in court.

    Good post Adrian

If one can hijack the judge's emotional brain (emotional brain is faster than our rationale brain) , place all the thoughts (thoughts become reality in decision making) in a very strong verbal presentation in court .Everything has to be verbally grind ed into the judge's memory in court ,

If one party does the same job , in a written witness statement , the verbal party in court is likely to win.Until solicitors and barristers understand the judge's state of mind , a lot more cases will be lost by poor representation.

The defendant was playing the "good little girl image " sulking for empathy in court and really getting negative statements , which were false , that I was swearing and hysterical etc .It is the ACT you put in court that matters. If your own solicitors and barrister are knifing you , it is over.

    Insurance companies decide court representation.

    No, much simpler than that.

If your barrister doesn't tell the judge your position, then the judge cannot be expected to be psychic.

    Another thing .

Solicitors and barristers tell you "good luck" before going to court. You feel like you bought a lottery ticket , and need some luck!I was hoping for skilled performance from them.
