So if they do investigate as fraud then they can't do me for not reporting change of circumstance as they have a note on file from January and I also made repeated attempts since. Can they?
Come on, the whole thing doesn't ring right and you know it. You might have a totally legit situation albeit totally unusual, just on the basis of 'who would marry someone who lives abroad with an ex partner'! However, you have lied to them and that you can't denied, so that could potentially open up to querying what else you've lied about and for how long.0 -
Although it might be argued that the OP has a responsibility here, it's clear that they did inform DWP of the situation and that DWP has failed to act. The person they spoke to did not have the authority to make a decision on whether they should remain on the system as a couple or not. That is down to a Compliance Officer, and it's a decision which can only properly be made, after discussion with the parties involved.
I do know that in some areas of the country there are very few Compliance Officers, and that the system for internal reporting to them changed a couple of years ago and was a complete mess. Referrals going to the wrong team and that team not passing them on; mailboxes to which referrals were sent were not monitored etc, etc. Staff in processing offices wasted huge amounts of time trying to get hold of the right people when a referral had been made and no reponse received. It's easy to blame the claimant, but from what I can see in this instance the majority of fault lies within DWP and their systems.0 -

It was not slanging but merely a question the answer to which could change any advice given. Not knowing your full circumstances I am in no place to judge.
