    No you misunderstand.

    What I meant was you cannot claim carers allowance for a person you are paid to care for.

    Although saying that I can't find that anywhere either, but it would be odd if you could be paid to care for them and get CA.

    However, we are no longer 'living together' as partners. If you know what I mean. We have no more a sexual relationship and both are involved with other people.
    She has been, and still is, on my ESA claim.
    This arrangement began end of January and I duly rung up ESA and informed them that my partner and I were no longer together and that I wanted her to be removed from my application.

    Are you saying that despite all your request for her to be taken out, they have insisted that she should still be on your claim, 4 months after you first asked them to remove her?
    It wasn't enough but as she was my carer she probably deserved it anyway. We agreed on 2 hours per day at £7.50 per hour. Again, nothing extravagant but it was enough for her to stay with me for my care.

    So she only provides 2 hours of care per day but yet claims CA which requires 35 hours of care?

    It seems like she is a partner when it suits and not when it doesn't. Sounds like you've claimed ESA as a couple when you were not and she claim CA when she is not fulfilling the requirements to be entitled to it.

    ESA and DLA provide my income.

    it amazes me that people thnk they can create ridiculously complicated situations and then wonder why their claims get investgated

    Yesterday, I received a letter from some fraud investigator asking me, as her employer, about how many hours she was working for me and for how long including pay rates. No mention that I was her partner.
    Also, out of curiosity, how did they find this out? Did she fill in a tax return?

    No, I didn't misunderstand.

    If a person cares for someone for at least 35 hours a week, they can claim CA.

    That's five hours a day.

    If the person being cared for also pays the carer for another two hours a day, where does it say that's not allowed?

    And people doing that caring can also earn over £100 in paid work before their CA is affected.

    and on the other hand disentitles (is that even a word?!) a lot of folk who do provide a lot of care whilst also working or studying (my carer has only been entitled to it for the past 6/12 but has provided well over 35 hours for several years)
