Car accident claiming back costs

    concert started 7pm in central london - not a chance of getting there, with kids dropped off

    our car basically was blocking a slip road for most of that time.

    What AdrianC is getting at is that you will have to show that you did everything you could have done to mitigate your losses. You have no case for the Liverpool concert because you could have attended that by various transport methods but chose not to.

    Fair play yes i get that

    but if companies seriously think I would abandon my car and/or my children to get a cab for mega money to then hire a car to then possibly miss it anyway, id rather not bother!

    i totally get where you are coming from, and thank you, but it is just so wrong that these compaies are very keen for me to have an injury - I even had to get my children to speak on the phone to say they were ok after the incident as they would not take my word for it, but its so hard to claim a genuine cost. The world really has gone mad

    My comments may come across as critical, but these are the points the other party would make in response to your claim.

    Again, that's your choice, but a defendant would argue that you'd rather not bother to reduce your losses?

    Put the personal injury business to one side. It's entirely irrelevant to a possible claim for your wasted tickets. The world hasn't gone mad (not entirely, anyway) - the small claims process is generally very fair and balanced. Put yourself in the third party's shoes. Would you just pay up in full knowing that the claimant hadn't put every effort in to try and reduce the size of the claim against you?

    Thanks. There are a lot of posters who don't take that approach and lash out when they don't get the answer they were hoping for!

    I think you're right, unfortunate as it is. At the end of the day, you were the victim of what sounds like a nasty accident that with just a tiny change of circumstances such as a different speed, position of other cars, etc., could have seriously hurt your family, or worse. Some lost tickets isn't a bad outcome in the grand scheme of things.
