Coupon-mad wrote: »Errrm, what? Are you saying the contract is with Excel, on the P&D ticket?
The p&d ticket is with excel yes
Putting 2 and 2 together here, can I argue vcs have no right of claim for an excel contract?
I don’t have the signage photos to hand to check whos name is on them, is the signage irrelevant if the p&d ticket shows excel?0 -

Lots of stuff available with the right searches. Hard for us to remember every one of them. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I didnt think anything of it even when coupon-mad made the reference to it yesterday. I included that line in my ws today and still didn!!!8217;t think anything of it. Forgive me, im slow off the mark.
Time for another addition to the ws0 -
If it's the same car park, you can include the Prankster's blog as evidence. If the PDT says Excel then the driver paid and formed a contract only with Excel. That's a major argument.
Sounds like your WS and evidence are stacking up nicely in your favour.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

And thats largely down to you, from day one youve been a great help to me, and im thankful to you for it
I will add more meat to the ws and post back here0 -
The signage on entry to the car park clearly states the car park is managed and controlled by VCS.
The pay and display ticket issued was by Excel Parking Services Ltd.
The Excel pay and display ticket says to refer to the notice board for terms and conditions, which has VCS name on it.0 -

I've not gone back through the thread to check, but if you haven't got your own photos of the signage on site, go and get that immediately.
Make sure that any text on signs is legible in the photos. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thankfully, I have photos.
Am I right in saying although the signage states it’s managed and controlled by vcs, the actual contract was formed when excel issued a ticket in their name upon payment?
VCS have no right of claim for a contract they didn’t form?0 -
Is it a ticket roll with Excel already printed on the reverse? Maybe they ran out of VCS ticket roll?
It would be a more convincing case if VCS were pursuing in a clear and obviously signed Excel parking site.
But I'm no expert on contract law, so you will need to have this tested by the Judge. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
