Horizon parking - small claims court

Coupon-mad wrote: »Absolutely diabolical, you need to complain about that wrong advice. A Horizon PCN is clearly a charge on private land, and the fact it was P&D makes no difference at all. The CAB are hopelessly wrong. Which branch?
However I am still concerned that this appear to be a driver who has been parking for free and actually the cause of the *success* of this industry. We help victims of PPC scams and we hardly see any cases where people are selfish enough to park without paying and displaying, lots of times, again and again, so I hope it's not a deliberate series of fly parking. It would be hard to support if that's what's happened.
East Dunbartonshire is the CAB branch. I do understand where you are coming from - however I genuinely do not who was using the car on these dates as they are all May/June 2016. I have used the car park myself and have paid for that privilege on many occasions. The car park, how it is run, the state it is in and the consistency/reasoning for ticketing in general is a shambles and well known by many in the area for this.0 -
OK, I felt I had to ask. I accept what you say.
You should complain to the CAB, formally, and tell them the advice was incorrect and misleading.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you can't prove who was driving on each occasion then the Sheriff will come down on you hard (there are people in Dundee who have been required to bring every person who had access to their car to be questioned by the Sherrif) so think long and hard before you listen to some of the advice on here, trying to steer you towards saying you wasn't the driver! If you wasn't the driver and you can prove it then expect the English charlatans to go after that person, so think long and hard First! I suggest you fight this on other grounds like signage.
Look into how to apply for legal aid if you are currently on benefits. Carly Mackie did this.
Don't pay attention to English people on here who know little about Scots law (other than their own wishful thinking!)If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.0 -

This type of fine is legally enforceable and does not come under the parking on private land section."
Has there been a misunderstanding? It sounds to me like they they think you're taking about a council parking ticket? Otherwise their advice is shockingly bad.
Please take no notice of Ryandavis1959 - he is a troll. He was involved in a bitter exchange with the regulars on this forum a few weeks ago. Where he just posted a load of angry drivel... He knows nothing about private parking cases.
That said Barry Beavis is indeed very knowledgeable but sadly some of his Facebook friends are not.0 -
Sounds like it's just shocking advice. Okay thanks. I'm going to spend the weekend researching and writing my defence. There are 3/4 questions on the form I need to answer. Anything I should definitely mention/avoid or any cases I should look at would be appreciated. I will post what I come up with here before sending off the forms0
