A highway maintainable at public expense is the responsibility of the Highway Authority, which may or may not be the local authority. A back lane may or may not be a highway maintainable at public expense.
So the local authority may be the Highway Authority and responsible for a back lane, but not necessarily.
A Highway Authority is never responsible for clearing litter, which horse poo would probably be classed as.A person without lawful authority or excuse cannot deposit dung on a made-up carriageway (Highways Act Section 148)
- but the horse can do what it likes.If any thing is so deposited on a highway as to constitute a nuisance and the authority has reasonable grounds for considering the thing unlawfully deposited on the highway constitutes a danger then they may remove the thing forthwith. (Highways Act Section 149)
