  • The NHS is a public body, thereby subject to freedom of information requests. It would be interesting to find out if they have sold many more permits than spaces for that £60 you pay each month...

    Have seen in other Trusts that they do. They give various reasons for this e.g.

    "green" policy, or
    not everyone will be there at the same time, or
    permit does not guarantee a space

  • I'm sure. But if there is no reasonable prospect of parking your vehicle, that may give rise to your own separate claim against your employer for breach of contract (sale of parking space, where in fact it was unlikely you would be able to avail yourself of it). Much will depend on how that permit was sold to the O/P.

    Hi all,
    I posted on this site quite some time ago when I received PCN from Oxford University Hospitals NHS Trust where I work.

    I have now been sent (after some time) an N1 Claim form from the solicitors representing the trust in the matter.

    This is not something I know very much at all about and i'm seriously considering hiring a solicitor with expertise in the area to take this on for me.

    With regards to the claims:
    Claims 1-3 all involved my car parking in the car park (not inside a bay) but certainly not causing any obstruction. Truth is the car park is rammed after 8:30am and the choice is either to spend 20-30 mins driving around looking for someone to leave or to place the car in an area where it wont cause any issues for other users and go see patients!

    Claim 4 - The signs on the floor to indicate disabled bay are faded to the point where only a slight yellow marking is discernible and nothing to indicate disabled bays. I will upload photos of this and other signage in the area tomorrow.


    What do you think my options are now?

    I would like to see/know what pictures they have available of my car on the particular day - is this done via the SAR?

    Did this Claim Form come from the County Court Business Centre in Northampton?

    What is the Issue Date on your Claim Form?

    You won't find a solicitor who specialises in these cases.

    Have you looked at the Newbies thread? It has a whole section on the court process and links to successful defences.

    At this point it isn't far from a standard ppc claim. Are they claiming contractual breach or trespass?

    They are claiming breach of contract and yes it is Trethowan's

    I'd love to post the N1 letter - but it seems im not allowed.

    Date of service on the letter is written as 10/12/18 although i only received the letter 5 days ago in the post!

    What do you mean when you say you can't post the N1? At this stage it is confidential.

    You would need to suitably redact it though to avoid showing personal information.
