PCN despite Blue badge

I have just received a windscreen Parking charge notice from UKPC on a free shopping car park - parked in a disabled bay and displaying a Blue Badge. £100 fine - was parked for 15 minutes tops, very quiet car park with plenty of other spaces around me. When I challenged the attendant he said he hadn't seen the badge but there was nothing he could do now the ticket was issued but that I could appeal. Obviously a quiet day for him so grab a disabled granny day - resisted the temptation to suggest Specsavers.....have seen a lot online regarding these tickets, some saying ignore but doubt that's correct ?

    follow the BPA advice in the NEWBIES sticky thread near the top of this forum , appealing around day 25 and add a note stating that AN OCCUPANT OF THE VEHICLE WAS A BLUE BADGE HOLDER and enclose or attach a picture or scan of the BB as proof

    also complain to the supermarket or retail park and insist on a cancellation

    DO NOT ADMIT WHO WAS DRIVING

    Correct, it's not correct, in fact it hasn't been correct for 4.5 years.

    Please read the NEWBIES FAQ sticky, post #1 will be enough at this stage, which explains how to fight these tickets successfully and even provides you with a ready written template for your first appeal to UKPC. It's likely to take a further appeal, but more of that once they've responded to your first one.

    UKPC are in deep do-do with HMRC, and may be wound up in a few weeks time. On previous occasions they were caught doctoring time stamps on photo' "evidence", so an employee saying he didn't see a blue badge is probably a lie.

    The blue badge scheme doesn't actually apply on private land, but the Equality Act 2010 does.

    As above, start by sending the BPA template appeal in blue from the NEWBIES thread around day 26 from the date of the alleged event with a copy of the BB as advised above.Wait to see what happens after that. If the company is wound up you may never hear anything from them again.
    If on the other hand your appeal is rejected, you then go on to read up about the PoPLA process detailed in the aforementioned NEWBIES.

    Don't panic, don't get angry, don't pay, don't ignoreget even.

    In addition, complain like mad to the retail managers where you visited.

    For this charge to stick, the PPC would need photographic evidence. Was your BB obscured by any chance? Also, come back when you get the NtK with PPC photographic evidence.

    I submitted an appeal - they sent me photos which I blew up and the badge was visible on the dash- sent copy of photo with badge ringed plus copy of blue badge and they have replied: Appeals manager has reviewed your case- however the parking charge will not be waived. However in consideration of info provided and on the basis that you are a valid blue badge holder, if payment is received within 35 days we will accept £15 in full settlement...failure results in debt collector etc etc Have heard they do this - should I appeal to POPLA ?

    This is a free car park so their only revenue is from this kind of scam...
    Grateful for any advice - don't feel I want to pay even a fiver to get them off my back !

    Have you raised hell with the shop/shops served by this car park?

    Don't just deal with the CS drone on the door, get the manager out from the office at a busy time and berate them loudly about this. Then if they don't take immediate action to get it cancelled, do not hesitate to escalate it to head office/MD level.

    Absolutely complain about disability discrimination and breach of the Equality Act 2010, to the site management of that retail park and get this quashed once and for all. Of course you do not pay them £15, the BB was displayed and their photos show it.

    Don't forget to prepare a POPLA appeal with our help, as well, if you can't get this cancelled early this month by complaining in the right ears about this discrimination.

    Their ticketer can't pretend he didn't see the BB, issue a PCN, then when sussed by his OWN photos, charge £15 to the BB holder. I would also take your evidence to Trading Standards, right now.

    If you don't want to pay a fiver then it would seem logic that £15 is out of the question!!

    Only you know how much you value your time and whether it's cost effective to end it now.

    If you go to popla and lose then the £15 offer will be off the table
    Your worst case scenario is this ends up in court and you lose. That will be the best part of £200.

    If they don't proceed to court then your worst scenario is up to 6 years of nasty letters from debt collectors. Easy to deal with by ignoring.
