    they both beat Gladstones claims in court and batted away this 'request for the case to be heard on the papers' in their threads.

    It's a real pity that some of the people we have helped with seriously in-depth advice, answering every inane question, as well, as the often complicated ones, can't come back and offer their contemporaneous advice to newbies going through the same traumas they have recently experienced.

    After all said and done, most of them now have far greater first-hand experience than almost every regular who puts in their shift every day of the year to help others. A real shame, but perhaps a reflection of today's society! I won't go on!

    Well done Lamilad on becoming a star of the forum in giving back so much of his knowledge of dealing with this stuff, personally gained over the past 12 months.

  • Hi all,
    Does anybody have any idea how long the Notice of Allocation takes? Or is it a case of how long is a piece of string?
    The case was transferred to my local court (thanks to the help on here) on 8th July, but still not heard anything. I am self employed, so unable to book any work in until I receive the notice.

    I would ring your local court and speak to a helpful admin/court clerk. Ask what's happening and explain why you need plenty of notice of the hearing date.

    BTW, don't forget to refer back to the NEWBIES thread because there is a stage in between - your WS and evidence.

  • So, finally got Notice of allocation, or so I thought..It states that the court is presently unable to find a date which suits both parties, so we both have to resubmit availability.... would love to know what gladstones wrote on their DQ, as we offered plenty of dates..wondering if this is because its at my local court, a fair distance away from their head office.
    anyway at least got name of DDJ who will preside, will hand in our availability again and see what happens.

    I, xxxxx of xxxxx, am the defendant in this case and litigant in person.

    1. The facts in this statement come from my personal knowledge. Where they are not within my own knowledge there are true to the best of my information and belief

    2. I am not liable to the Claimant for the sum claimed, or any amount at all and this is my Witness Statement in support of my defence as already filed.

    3. I assert that I am the registered keeper of the vehicle in question in this case, and I was the driver on the date in question.

    4. On thexxx parked a xxx, registration numberxxx in a car park on xxxThe vehicle was parked wholly in the bay with no overhang. (Exhibit 1).

    5. There were two entrances to the car park. Due to a height restriction at one of the entrances I had to use the one shown in Exhibit 2

    6. I paid a fee of £3.00 which meant the ticket would expire at 15.48. (Exhibit 2). I then left the car park.

    7. Upon my return to the vehicle, I found a Parking Charge Notice had been left on the windscreen. This had been issued at 15.01, well before the ticket was due to expire. (Exhibit 4)

    8. I was, and still am, unsure of the reason for the charge due the scant details given on the notice. It merely states ‘Insufficient Fee Paid’.

    9. In order to try to understand why I had been issued with a ticket, I walked around the car park.
    At the other entrance where there was a height restriction there was a sign indicating that there was a higher fee payable for vans. (Exhibit 5). At the entrance with no height restriction, which I had used, there was no such sign.


    10. Due to the lack of details on the Parking Charge Notice and the subsequent ‘Notice to Keeper’, I can only presume this is why I was issued with a ticket.

    11. I have received several letters from SIP stating that I owe the Claimant varying amounts with no explanation throughout as to how these fees have been calculated.

    12. In June 2017 I received a card from Royal Mail informing me that there was a letter to collect from the sorting office. After I had driven to collect this, it turned out to be a copy of the Directions Questionnaire from Gladstones Solicitors. The sender had failed to put any postage on the envelope, so I had to pay £2.00 to collect the letter. (Exhibit 6)

    13. Conclusion – no evidence of contravention and the Particulars lack any basis for a claim






    I believe the facts stated in this Witness Statement are true.

    May seem an odd question but what did the SIP paperwork say the driver had done. Your own comments suggest blocking/over a line but what does their paperwork say?
    The van was inside the bay apart from slightly hanging over at the back, but was in no way obstructing anybody else or another bay.

  • Not an odd question, the letter from SIP only states ‘insufficient fee paid’ .
    I’m just presuming that this is the reason.
