Bought a car from a dealer - It is FUBAR'd after a week :-(

    For £2k vehicle, the small claims court would consider whether it's fair that the brakes should fail so soon at such a considerable cost and that all the faults listed in your initial post are also reasonable. It'd be surprising if anyone thinks these issues are what you'd expect on a £2,000 purchase!

    The "new MOT" has changed nothing, all that has changed is the tester has to sit infront of a computer before and after the test for 10 - 15mins. They can still cheat, what they can't do is issue more test certs than they can physically do in the garage.

    Have you spoken to the trader? I recently bought a seicento for £1800 for my son on passing his test. Filled the tank up at a local garage, during the drive home the car smelled strongly of petrol. On checking the tank it was corroded through. Overnight on the drive also showed an oil leak. Phoned the trader and he was most apologetic, told us to bring it straight back, and had all the work done without question, plus a new exhaust pipe. So we were well pleased. Thing is, all we had was a 28 day engine and gear box warranty, and they are a bit of a 'back street' outfit, so I expected a bit of an argument and maybe to have to involve the credit card company, but they couldn't have been more helpful.

    So, contact the trader before you panic! But if worst comes to worst, you should be able to claim from your CC company

    You could take it to your local VOSA station.

    You could get the MOT issuer to pay for the repairs to the items which should have been spotted at MOT time, but that won't include things like the gear box.

    You could start off going back to dealer quoting sales of goods act, and ask them to repair all the faults or if they prefer a refund. (you cannot demand a refund). If they refuse to help, your best course of action could be to get a solicitor to help you, or the CAB.

    cant access the policy dosc however its 2* policy is basic drivetrain & electrics.
    worryingly they have a seperate 4x4 policy which may render your policy worthless

    I've just spoken to the dealer who has said,
    "You need to get it fixed under warranty"

    So I'm going to give them a call when I get in from work and see what happens.

    Of course he'll try and fob it off on the warranty, otherwise he'll foot the bill. Give them a try but whatever happens the sale of goods act should still protect you...

    the warrenty doesnt absolve(sp) them from their responsibility as a trader.
    the cant just act like a private seller when it suits them and a dealer for the sales premiums!

    You might want to think about a full RAC (or similar) inspection. This might be one of those occasions where professional advise (solicitors) is the best way to go.

    Is the warranty going to repair the bodged up rear end? I doubt it. Is the bodged up reaar end safe? would it (should it) have passed an MOT ask your local VOSA for an inspection. If it is dangerous and/or should fail MOT, you can claim against the MOT test station.
