    You do,but by following Paypals process,you have to follow their rules.
    They wont make a seller pay return postage.

    It is an online company. I have had blinds off them and they were amazing. Don't think I'll be going there again

    Why do you not want to name them? We cant give you much help without knowing who they are. People may have had dealings with them before.

    I'm not sure if I can do that as it has gone through Paypal. Last conversation I had with pay pal is they are disputing what I'm claiming. It just a big mess

    You only paid through PayPal, you ordered through them.

    Have you called all the numbers on the website, the retails stores ones must be able to give you the correct person to contact.

    I tried originally when the number wasn't recognised. Since then I've spoke to pay pay as I had opened a dispute . I just thought Once you had opened a dispute you had to carry on with it. I just thought it would get sorted as I thought pay pal offer all this protection.

    Yes they are disputing it. However you go back to them (retailer) and tell them that under the Consumer Rights Act, risk does not pass until the goods come into the physical possession of the consumer or someone identified by the consumer as authorised to receive the goods. As you didn't authorise anyone and can (presumably) prove you were on holiday at the time, you feel quite confident a court will agree that risk has not passed and the liability remains theirs. Perhaps also add a reminder that they are liable to you for the negligence/failings of any third party providers they outsource to and it would be up to them to then claim from the third party.
