Help with parking eye CCJ

Hi all

I'm in need of some advice/guidance as have no idea what to do!

I did a credit check yesterday as want to apply for a mortgage as a first time buyer. It came back as 710 Poor. I found out that I have a CCJ. I rang Northampton county court, as I had no idea about this.

Apparently it relates to parking notice from parking eye at a local hospital from September '15. The CCJ is from January '16 for £170.

The initial parking notice charge and the court documentation must have all gone to my old address. This is my own fault as I was moving a lot and so forgot to update my V5C.

I checked the date on my online banking and I paid parking eye on that day with an amount for all day parking and was parked in an area as far as i know that I can park in so am unsure why I have been fined.

As far as I can work out I have 4 options;

1. Pay the fine and apply for the CCJ to be satisfied and then take hit from mortgage companies (am unsure how negatively they will look at this as its a small amount. I'm buying with a partner who has excellent credit and we have 15% deposit).

2. Contact parking eye and explain that I paid and ask for more details and if they will work with me to set aside the CCJ by consent.

3. Apply for the CCJ to be set aside (will be £255), hope the judge will see in my favour as I never got any notice of this happen (although its my fault) then try and see the case through again and argue that I shouldn't have been fined.

4. Lawyer up and get them to contact parking eye/courts as I have no idea about this stuff (be very expensive for what is a small fine that I can pay now)

I am obviously really upset and annoyed by this as its mostly my own fault and in 2016 have had two other parking notices from parking eye both of which I contested and won and they never mentioned this outstanding one.

Another factor is I really want to buy a house and not rent for another year and this all seems like it will take ages so am tempted to take the possibly quickest and cheapest option and take option 1...but then it might not be cheapest in long run in my mortgage interest rates are raised because of this!

    The options you've detailed are pretty much nailed on. Personally I wouldn't bother paying a lawyer as they aren't very clued up on parking matters. The easiest option is a set aside with consent but you may wish (and have fairly good grounds) to fight this.

    Option 3 with a string complaint to the hospital. which hospital was this?

    Sorry I hadn't read the sticky NEWBIES post before as my thread was moved over from another board. I have read through the post in that thread and others.

    I think I would like to go down my option #3 of trying to get it set aside and have it revoked but have some questions about this as my situation is different from those in the other post.

    1. Would I be able to get the CCJ set aside in the first place? In most the examples in the sticky thread people have had royal mail forwarding post or had applied to have it changed etc and its been quite soon after they moved.

    2. Is it worth talking to PALS at the Hospital (Sunderland)? or as its now gone to CCJ is there nothing they can do?

    3. In terms of trying to have it revoked, I still have no information as to why I got a parking charge. As far as I know I paid on the day and have evidence of this. Therefore is there any way I can get more information on this? From other posts parking eye don't seem forthcoming with providing you with evidence once you have a CCJ. I maye have been parked in wrong location or over stayed (although I sure the amount I paid was the old all day price)

    Never admit to being the driver. You are the registered keeper and are acting as such. They have taken action against the registered keeper and not the driver so keep it that way.

    You can only redirect mail for 12 months so after 18 months wouldn't have got any paperwork anyway. That is academic though. Ultimately you did not receive the paperwork and so a set aside should be granted. One thing to be aware of is that sometimes these things can be a bit of a lottery but don't let that put you off.

    Yes involve PALS. If a set aside is granted the claim restarts so they could get it dropped before a fresh hearing.

    The details of claim should state why you incurred the charge. If it doesn't that is good grounds for your defence. If they can't tell a court what the charge is for why should a court uphold it?

    You can have postal redirection for at least 24 months. I know because I moved a year ago & just renewed my redirection after receiving a reminder from Royal Mail that my first twelve months was almost up. It's only £62 for a year & money well spent.
