Manager lying in order to Dismiss me

    Yeah basically if they want to get rid of you then they will, even if they have to find another reason. Do you mind telling us/me what it was you did, im interested now that you say it was in the papers.

    I agree with Sangie that crim record shouldnt be the end of the world but it prob depends on the type of offence, if you was done for shop lifting, i wouldnt have you working in my shop, drunken disorderly type thing at uni, yeah ill let that slide if you've been out of trouble since then.

    Of course, ive you've murdered someone (I know you haven't) then im not interested, no matter what, for my safety and my employees.

    You obviously don't read local papers much. I live in a pretty big place, and our local paper would find you a space for jay-walking! Just because something got into the paper doesn't mean it was even vaguely interesting.

    You are correct, i don't read them nowadays. Yep, it may be minor i suppose. I'd assume the employer knows what it is and it may be the nature of the offense that is causing them to go to these measures, just speculation, like you said it may be minor.

    Thanks for all the replies.

    In short, I did something silly/embarassing and was given community service/supervision order which all ended last year. The position I applied for within the company sees me working on quite lucrative contracts for this large organisation, so I understand that in learning about the conviction they were concerned 'what if the stakeholders find out' etc. But its a huge company, I am only one person and I was doing a good job.

    They've dropped that aspect of the investigation now however, and rather than the conviction itself, they are focusing on an allegation that I lied about a reason for leaving my previous employer. Basically, they didnt ask something along the lines of "Oh I can see you were that company for almost 10 years, why did you leave?"... which is common to be asked.

    I fear they will be thinking 'how didnt we spot on his CV he finished that job a few years ago'. They maybe just assumed I was still there but I was careful to answer my questions in the past tense incase I gave the impression I was still there. My cover letter and CV blatantly state I had been doing agency work over the last couple of years.

    I've contacted the union for assistance, and two charities that work in partnership with my company.

    I think its quite clear however, given that Ive only been there for a few months, that they will just follow their procedure and evict me! There disciplanry policy is pretty terrible in the sense that basically my manager, and a colleague he fancies selecting, can together work there way through the whole process with any input / attendance from HR. Its not particularly impartial given that the latest allegation is basically from my manager, who is the investigating officer.

    I thought I could put a grievance in to slow the process down in order to get help from the charities, and hopefully get attension from HR as to how this is being conducted.

    Its an incredibly difficult situation because in 2015 I was offered 3 jobs that all fell through because of the conviction, but I wasnt disheartened because I knew I could do agency work to get a good 'most recent employer' reference, and I also knew I was getting closer to the conviction becoming spent.

    A local authority offered me a job even though I had to state on the application dismissal for the job I had at the time of the offence. I even put in my personal statement that I had lost my job and was looking for a second chance.. but when they called to offer me the job the plonker said "how many weeks notice do you need to give"... and I replied in a confused voice... 'Im not working at the moment". A few days later they obviously read over my application again and later that week I was told my references were not satisfactory even though I saw copies of them.

    A large rail company and a large water company did similar things to me that year. I stupidly sent a disclosure letter to each of them once I was verbally the job, suspecting they might ask anyway, but to appear open regardless given what had happened with the local authority offer fallingn through. Both withdrew job offers.

    So with this current job, I just felt positive that the conviction was virtually spent and glad they didnt ask anyway. When I phoned family after the interview, I was admittedly relieved they didnt probe about my career history. It was common for that to happen and when it did, I had to hold my hands up.

    Theres a very fine line between focusing on the positives in your career and skill set, and being too honest about a mistake in your past that made you a stronger, better person.

    HR are there to cover the employers back and not to help you. Remember - they wrote that terrible policy you are complaining about!

    A grievance won't slow anything down.

    Why have you involved third party organisations in this? Just because the company had a relationship with them does not mean that they have anything helpful to add, and frankly, if the company find out, I suspect you have just handed them "bringing the company into disrepute". This matter has nothing to do with external charities.

    Yeah ask the charities to stay out of it, hopefully there isnt anyone in there who is friends with management at your company.

The company frequently published articles and tweeted about their collaboration with a particular charity that assisted ex-offenders into jobs, so I contacted that charity to alert them my company were ignoring all of those practices in order to dismiss me.

    I was desperate and frustrated that one minute one of our company directors was publishing an article on our website saying 'How ex-offenders strengthen our Business' (referencing work with the charity)... and on the other hand here was me being disciplined for having a conviction.

    I feel my only hope is...

    1) They have a little bit of guilt and at least re-deploy me to a role that isnt as outwardly facing.

    2) The charity that are helping me have contacts in HR that may feel angry to learn of how I am being treated. Its one central HR team for a 30,000 employee company. So there is a chance HR might be miffed managers are abusing policies.

    Its a long shot.
