It isn't a precedent, and estoppel is an age-old equitable remedy! But yes, it's useful for people to point to this as an example, although of course there is no court judgment or finding or anything in the public domain that can be produced as a concrete example.

I am not slating you, and I commend you for trying to put right the damage you have caused.
I am in exactly the same position as you. I own a flat within two minutes walk of the town centre. It was a magnet for cheapskates to park for free, we installed a rising bollard, but drivers delivering to a restaurant in the complex destroyed the side barrier and drove round it.
We did not employ a PPC though. I let a few tyres down and blocked in a few interlopers, illegal I know, but difficult to prove, especially against a stroppy landlord occupying the moral high ground. The problem we landowners have is that the law is on the side of the lawless, cf rent arrears and squatters.You never know how far you can go until you go too far.0 -

We enter into these things in good faith as most landowners do..... It is a shame we get let down. I personally think over time the ANPR systems will die a death on retail sites. They are causing so much grief for landowners they just aren't worth it. I was pleased to hear ASDA gave Smart parking the boot. Interestingly Aldi are not renewing their Parking eye contracts in many circumstances and I have also seen some new Aldi stores with no enforcement.
If the industry act in a manner like CPM have towards us it will eventually purge itself.... but that is a way off.0 -
Personally, I have a lot of respect for @mistercesq.
He had a parking issue, he tried to resolve that parking issue (unfortunately taking the wrong option), has had problems with the people he contracted with but is now going over and above to sort it out, being completely transparent about his experience and also coming on here to publicise the view of the landowner for others to benefit from.

Mike is a bit of a legend. It was like watching the weekly football results. If he played football he'd have won the Premiership, FA Cup and the Champions League!
