I read it, the letter I am suppost to send is to complain about the sign, but my case is different.

Everyone says their case is different, or special. 99% of the time they are wrong. The newbies thread provides a generic approach to appealing 'charges' from this scam industry that avoids getting into specific mitigating factors or god forbid, naming the driver.

Read it again, and on a decent sized screen. Takes some time to absorb it. Please don't fund this borderline criminal industry by throwing in the towel when nearly all cases are winnable if handled carefully.

No it isn't. What part of the NEWBIES thread template appeal is confusing?
I think I will just give up and pay the charge.

That's naive, supporting the con and letting the side down - hardly in the spirit of MSE to pay a scam just because you need to read a thread that's right at the top of the forum calling to you in capital letters to read it first.

The pre-written words are there to copy; not sure how much easier I can make it.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The letter I am suppose to send is for this template

Template appeal for BPA members - copy this wording into the online appeal box or into an email:

    Dear Sirs

    Re: PCN No. ....................

I challenge this 'PCN' as keeper of the car.

I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

But it is doesn't fail large lettering, unless this is just a made up excuse just to start an appealing process.

So you could read every word of the sign when you drove into the car park at 15mph could you?

It's up to them to prove they are readable they have started this process not you.

The greedy PPC is only after your cash in the easiest way possible, they always reject an appeal anyway yes you want a POPLA code, but the templates on here are tried and tested and show them you are no push over.

You are tying up people on here with unnecessary questions when it's all there for you to follow!

I take it that you have read and are fully acquainted with the ParkingEye Ltd v Beavis case to make such a categoric retort?

Which parking company are you dealing with?

The idea of the template is to get a PoPLA code so you can make a second stage appeal and win. The PoPLA template appeal points are already written for you and include Inadequate Signage, Not the Landowner, No standing to bring charges in their own name, non-POFA compliant NTK, lack of grace periods, and several other that may also be relevant.

Use the template exactly as it is. Copy and paste and send. However, are you sure your PCN is from a BPA member? You haven't told us the name of the parking scammers.

There really is no difference between your case and the thousands and thousands of cases that have appeared here before yours.

Do not pay, do not ignore, do not reveal who was driving, do not miss the appeal deadline.

This assumes the alleged event happened in England or Wales. Advice for the rest of the UK is different.

I went to the store where the car park where this happened and complained to the manager, he asked if this is the first offence which it is, then said he will submit a request to cancel the charge but he can't guarantee they will do, it is their car park and it is their decision, but he said he thinks they always cancel the first offences, but he never hear back from them.

I guess I am going to wait befor submitting the appeal now.

Should I expect to recieve a letter about cancelling the charge if they decided to?

By the way, this is EuroCarParks.

Give it a few days then go to the ECP website and use their 'Pay My PCN', or whatever they call it. Go as if to pay by entering your PCN number, VRM etc and that should give you the current status of your charge. But don't miss the 28 day deadline for your initial appeal if it remains showing as 'current'.
