Ok now on I will ignore letters from this company unless there is proper letter from court or similar one then I have to respond to them with the defence of unclearly stated sign, no information etc and if they still want to carry on with claiming back money they think they own I will then make up my defence letter from one of your templates and defend myself at court? As I understand. Hope they will go away as quick as they appeared.

Thank you I will get back to you all with some news some days later.
  • Yes but don't ignore any letter from a solicitor which is headed Letter Before Claim/Action or Letter Before Court. If you get one of those you need to answer it. Come back on here when/if you do.

And gather evidence now before they change the current arrangements, as I said.

    Hi All,

Yesterday I received letter with heading Invoice from them again with stating if I don't pay until the end of this month there are 2 action to be done. First is bailiffs or how you call it and second is court.

Do I have to answer to this letter or leave it? As this is first letter with heading Invoice.

    Thank you for responds.

    Who sent you the letter?

Bailiffs can't turn up without your case going to court.
Bailiffs can't turn up unless you lose at court.
Bailiffs can't turn up unless the PPC then seeks a High Court writ.
Bailiffs can't turn up unless the High Court sanction enforcement action.
Bailiffs can't turn up, because they can't get a writ unless the charge against you is £600 or more.

Do you think bailiffs are now going to turn up?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I received the letter from VCS or excel as they are probably 1 company with red heading invoice saying if I don't pay £100 by the end of this month the further action will be taken against me and underneath was stated court and balliffs. I read lots of threads about this so I will not do anything as I already appealed at first when I got this charge. I have all photos as evidence so If needed I will take this further. Just wondered if I have to do anything with this letter or just ignore it. Thank you.

Is it headed 'Letter before Action' or 'Letter before Claim?'

Or just 'Final Notice', or what?

Hi it is notice of intended court proceedings where they state they are disappointed that I failed to pay, if it will not be paid to deadline they will commerce legal proceedings such us county court proceedings they wish to bring to attention parkingel eye v beavis 2015 in which the supreme court held that parking charges severe a legitimate commercial interest and are neither extravagant nor unconscionable. If they succesgulky obtain CCJ agains me it will be recorded on my credit for 6 years and they can deduct payments from my wages, bailiff will visit my home or attend court for questioning.

    What should I do?

If I had chance to get temporary permit for visitor stay I would but if there is no chance no information on their signs and my friend just moved to the flat without any permits it is clear I'm not going to pay for this. It is not my fault nor my friends fault that he didn"t obtain permit for visitors. I parked on the space where I should notbtaking parking space of anyone living in the flats.

Reply to them in the style of the LBCCC responses, shown in post #2 of the NEWBIES thread. Expect a court claim soon, be ready to defend, again you need to read post #2 of the sticky thread to be informed and ready.
