Hi all,
I've been reading lots of your posts after I got PCN on private land. I came to visit my friend who lives in flats that have their own parking site. There were as usual parking bays with numbers on where you can't park unless you have a permit with your reg no and number of your flat. And then there are visitor bays. I saw signs all over of course read them through and there is no information about visitors no specification of if you can park on visitor bay or you need to have permit on your windscreen neither my friend haven't received any other permits than his for his own car. I found the PCN morning on 02 of April and in bad mood opened and went straight back to my friends to make an appeal on their website as per information on the piece of paper.


Now I'm reading not to appeal straight away, obviously I already did and can't really remember exactly what I put in that appeal. It was something like I visited my friend and parked on bay for visitors and neither me or my friend received any other permits so didn't know I can't park there. I stated that my friend lives on that site in flat.


I made appeal on 2 of April and received confirmation e-mail on 14 of April sent by Excel Parking Services Limited with attachment of letter with heading of Vehicle Control Services LTD as stated bellow:


Dear Ms
Re: Parking Charge Notice Number VCSxxx (Vehicle: xxx)
Site: xxxxCar Park
Issue date: 02/04/2017


We refer to your correspondence received in connection with the above Parking Charge Notice (PCN). Please ensure that all correspondence going forward is received through xxx website in order to correctly adhere with the appeals process. We have now made a decision on your appeal against the above Parking Charge Notice (PCN) and details of our decision have been sent to you by post via the address you provided within your appeal. Upon reciept you will find enclosed all relevant details, including a formal Notice To Driver (NTD). If for any reason you do not receive our decision, please visit xxx website and ensure that your contact details on system are correct and, as necessary, amend them.

Appeals Administration Team Central Processing Office

Can anybody help what to do next? I saw many templates made for certain companies but I'm still not sure first I want to hear opinion from someone.

    You've appealed, they will REJECT. Check your emails/junk or spam folder.

    Get evidence proving that the signs do not say anything about visitor bays or permits, take photos and show us here.

    Yes they rejected and said it is for permit holders only on the sign but I understand that it means when you park on numbered bays not on V bay. How can I add photo her from my folder in my mobile? It only says type in url of your image. Thank you

    You'll need to first host on something like TinyPic or Photobucket, then post the URL, but newbies can't post live links, so change http to hxxp and a regular will convert it to a list ve one.

    Restricted linking privileges as a newbie until you have around a 15 post count.

    OK, so now they have rejected it you will know from reading post #3 of the NEWBIES thread, not to try IAS but to just ignore them unless they get BW Legal to try a small claim (we have helped all posters win and defend v BW Legal so far, for a year).

    You would be defending on this reasonable basis, using case law such as Jopson v Home Guard. As a visitor, unfamiliar with any parking regime, the Visitor bays needed to be clearly marked in their own right as to what was required, so what you say here is relevant in due course for a defence (not such a big deal as it sounds):

    Ask your friend to dig out and keep safe, their tenancy agreement and any paperwork or email that came with his/her actual permit, to show that nothing has ever been communicated about visitors also having to display a permit (are you meant to be psychic and where do these 'visitors permits' come from if a resident doesn't have one).

    Anyway no steps to take now except for you to do your homework, read post #3 (and #2 about court defences) of the NEWBIES thread. And then search the forum for 'BW Legal defence' and read how everyone else fights and wins v this threat.

    I asked him if he was familiarised with parking agreement and what should he obtain but on his tenant agreement there was nothing mentioned so thats how is works on this parking site. You have to find out yourself what is needed if you want to park there. He told me "well if you parked there and on signature there is permit holders only it doesn't matter what you think" well my opinion is anyone can understand the signage its own way. But I think if you have 2 different designated bays you as company should specify bays with numbers and visitor bays. Only my opinnion. It is only £60 if I pay until 28th April it is not a pronblem but it's not fair for me as new visitor.

    Not a single person here is disagreeing with you and NO-ONE is encouraging you to let the side down and actually pay. Please don't, this is why we fight these charges. Can't stand it when we give advice and (rarely) victims are so weak they decide to pay 'for a quiet life' which just means they are sponsoring a scam and supporting the protection racket and the next PCNs.

    You need take no action, get on with life, come back if you need a defence, We win 99% of the time (not joking).

    Good morning,


    Ok, If I don't want to pay but also don't want to have any problems with it, what do I have to do in next days? I gone through newbies and templates and advices but because I'm not English it will be harder for me to defend myself properly if you know what I mean because about half of the sentences in these long templates I don't quite understand.

    IGNORE anything EXCEPT either an LBC from VCS (or EXCEL as they often get mixed up themselves), OR if you get letters from their legal services like from BW LEGAL for example

    and/or

    come back for help if you receive a postal MCOL (google it) from Northampton BULK CENTRE

    THE PPC HAS 6 YEARS TO TRY A COURT CASE IN THE SMALL CLAIMS COURT

    you wont stop the letters demanding payment, this is why we say IGNORE anything except an official LBC or an MCOL from Northampton
