@NTPalmer. you likely got to this thread through Google so, if you go to the top of this thread and click "Parking Tickets, Fines & Par..." it will take you back to the main page of this forum. Then in the top four links that remain at the top of the list you will find this link:

"**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!" ... click it and read it.

When you are done reading it create your own thread "New Thread" button on the forum main page asking the questions you still have. Please don't add your questions to someone elses thread as it is one thread per person to avoid regulars getting confused and giving the wrong advice to the wrong people.

Happy reading and create your new thread when ready at which point you will get lots of help and assistance with your issue,

    Hi all,
Update on this thread from a few weeks ago and request for further assistance.
So the NTK arrived and I followed the process advised and used the IPC template. I am sure you are not surprised but yesterday I had an email stating the appeal had been rejected and that my only option is to appeal to the IPC.

I have read through the newbies forum and although this is seen as pointless "Kangaroo Court", some say go through this process and some don't.

I did get some answers to the questions which I can post here if of benefit.

I have spoken with the driver and they remain happy to continue. To use their words "All the way to court if required" so we are looking for the best "next steps".

Thanks in advance for any and all help!

You can try the IAS but please bear in mind it is heavily biased and you will need to prove every point you make absolutely and completely, if there is any wiggle room or doubt they will immediately dismiss your evidence in favour of the PPC.

For example on another thread someone appealed the point that "they had never been given or received a permit of their parking space". The IAS said that they had not proved they had "never received their permit" so they could not dismiss on this point (note: they did not ask the PPC to prove that a permit had been sent and/or signed for)

Assuming the IAS reject your appeal or you don't bother, the next steps are filing away in a folder for future reference the hysterical stream of Debt Collector begging letters and wait for a LBC or MCOL from the PPC Solicitors. At that point you need to defend the case as the RK through the Small Claims Court Process.

No 'next steps' with an IPC operator, other than to ignore anything else that comes your way - except a LBC or real court papers which should not be ignored.

UK Parking tried a few court claims last year, but seem to be a bit quieter this year. Maybe the fact that it costs them more to pursue through court (and with added admin to do to prepare their case) than they can ever hope to recover, has cooled their ardour!

Thanks both. OK so my next steps are to buy a lever arch file and some plastic envelopes then for filing!

Yep - avoid the IAS like the plague, it puts people on the back foot when you lose. No point handing the scumbag companies an 'advantage' to wave in court:

''look, yr'onner... this has been through INDEPENDENT ADR and we won'' (truth - no, it hasn't...but Judges don't know).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi all,

Firstly thanks again to everyone on here that has provided valuable help on this. I just have a couple of questions if ok.

    1. I followed the advice and sent the IPC template to UK Parking Limited appeals process once the NTK arrived and then received a "unsuccessful appeal response". If this is expected I am just curious why this process is required? Is it to show you have followed their process? Not questioning, just curious.

    2. Now a NTK has arrived with details stating £118 is owed and if not paid within 14 days this will be passed to a debt collection agency, what is the typical next steps? E.g. More threatening letters? Increasing amount to be paid etc?

    3. Just wanted to triple check that the next steps is to do nothing. I have spoken with the driver and they are happy to continue this process to the end, just curious on typical timelines etc.

    Thanks again

    1) If the PPC is litigious, ignoring will result in a court claim. A judge will then want to know why you ignored it. Not ignoring it makes you look reasonable.

    2) Next steps are, you may receive threats and begging letters which can be ignored. You may get a LBC which you must not ignore. This could go on for up to six years.

    3) Nothing has changed since you last asked. The NEWBIES is still up to date.

  • Hi GrahamLea,

Can you update the status? Are you still being hounded by debt collectors/letters chasing for payment?
I am the keeper of a vehicle who has just received a PCN from UK Parking Ltd as well.
The charge was parking outside of designated bay.
It was unreasonable as only the front right wheel was over by about 2 inches.
I would not be paying but curious as to 1 year later, what is the status of your case?
    Thanks

Response from GrahamLea via your above post is highly unlikely as the last time he visited the forum is June of last year. But you could try to send him a PM, as he should then receive an email to notify him of your PM contact.
