    Which fundamental term? Which part of the contract states that doesn't have to work on Saturdays unless she wants to?

    Where are you getting the idea that not working on Saturday is a fundamental term of her contract?

    They cannot.


    Stating that the OP's wife should resign - having done nothing wrong - is not only bonkers, it's negligent.


    I realise your stance across the board is invariably: oh, all is woe, employers will get rid of you, so don't bother - but that is why the law exists (to protect employees).

    Sorry but I totally disagree.

    Nobody is disputing that this lady has a right to opt out of Sunday working by giving the proper notice.

    However I fail to see how you can categorically state that they are "now attempting to unilaterally alter a fundamental term of her contract". As I understand it her contract requires some Saturday working and may well allow the employer to insist on a higher number of Saturdays than she is currently doing. Also, I see nothing wrong with them offering to relax the number of Saturdays in exchange for working some Sundays providing she is not forced to do so.

    Finally, your comment about Sangie's posting style is nonsense.

    So yes im afraid to say the law states a employer does have to rearrange there business requirements to accommodate her request as its all in Black and white.

    I didnt make it...some clever soul in the Government would have...
    Just to clarify again, this is where you are totally wrong. The law does not state that an employer has to rearrange their business to accommodate her request if part of her request is not to work on sundays AND saturdays. They have to for the sundays, but not the saturdays. That part you are making up.

    She works in retail but wants to opt out of working the 2 busiest days of the week?

    I think she ought to find another job. They have given her the option of working Saturdays, the fact she can't because of childcare is not their problem.

    I said Sundays...she doesnt work saturdays so why would i say Saturdays..trying to pick holes in questions or my replies,honestly couldnt give a toss for your opinion.

    Others assumed she works saturdays and then people reply to the wrongly assumed posts and then its complete nonsense.

    Id rather listen to Acas than you...

    Give one or dont im not worried either way...but at least get it right :rotfl:

    Why should she have to find child care..she has agreed a set number of days per week and has simply taken the legal option of reducing one of those.

    Really isn't difficult to understand...why should she suddenly switch to a day that's not convenient.

    This was agreed with team leader and store manager..3 months pass and manager is now refusing to sign new contarct and states that wife must still work every other sunday or every other saturday

    You really need to sort your attitude out!

    Read your very first post where you clearly said "still work... ... Saturday" then apologise!
