You should absolutely complain to the insurer, and up to the ombudsman. Partly because you've got nothing to lose, but also because I think you have a good case. It's a pretty ludicrous claim from Hastings that they'd have refused to insure YOU if they'd known about your mother's ban.

    What's ludicrous?

The risk presented to them was the OP and a banned driver (without the ban declared). They quoted and accepted cover on this basis.

If the OP wanted to not have the banned named driver on the policy then they should have proposed it that way. It's immaterial that they may have quoted without the banned driver, that's not what was asked for.
  • Using your parents details to obtain cheaper car insurance is 100% illegal its called "fronting" , regardless of the fact your mum was prosecuted for drink driving or if you failed to notify them in time you have still broken the law and now admitted to it on a pubic forum , that's not unpleasant or judgemental its a fact

    Ignore this.

In fact it is one of the MSE tips on reducing car insurance.

Nothing illegal at all about adding mature experienced drivers onto a policy as named drivers in order to reduce the premium!

(The OP's problem is nothing to do with "fronting"!)

Thanks to OP for coming back to give us an update.

If you have a new policy, I would be interested to know what effect this has had on your new premium?

It has basically doubled from around £550 to £1100.

A couple of other things I didn't mention on here that people may find useful are that 1-The back door of the house was unlocked when the car keys were stolen and 2-My home address had also changed, so the address on my policy was different to the address I was living at and the car was stolen from. Hastings told me that they were prepared to pay out for the claim after looking into this, but they then voided my policy after seeing my named drivers.

Right, but here's what we know: "Their reason was that if they had known my named driver was banned they wouldn't have insured me"

"Me" being the key word there. The advice regularly provided on here is that insurers need to resolve these issues in a way that's consistent with what they'd have done if correctly informed up front. Had the OP informed the insurer up front about the ban, the insurer would have declined the addition of the named driver to the policy. They wouldn't have declined to insure the OP at all, so it's not reasonable to cancel the insurance entirely.

Try the ombudsman and then sue them.

The fact one of the named drivers happened to get banned has no bearing on the theft.

There's a thread on consumer action group re the cancelling of policies, what they have done is unlawful.

Wrong. Systems don't work how your suggesting. If the OP proposed a risk correctly with a banned named driver on the quote, the quote would decline. Not be offered excluding the driver.

    Hi All

Not sure if anyone will read this now, but I have another question.
I have now had insurance on a new car for a year and it is due for renewal. On my current policy I told the insurer that I had void insurance, but can't remember if I had to mention this claim. While inputting the information for a quote now I have mentioned the void insurance but I'm not sure whether to mention the claim.
Basically, my question is since they voided my insurance after looking into the claim I made does it still count as a claim?

    Thanks for any help!
