If my rent is taken on the 23rd then when should I give notice. That means I have to wait to 23rd of april and give notice? If so that will give me 2 months almost to look for a new place and since the rent increase was set to be from may1 as they said in the section 13 that means I avoid paying the higher price.
You can give notice now.No reliance should be placed on the above! Absolutely none, do you hear?0 -
Yes but the notice if I give it now I can do so for leaving a month after the 23april?
I don't wanna right away, just weigh things up a little more but in a day or two, maybe tomoro. Staying is out of the question so sooner the better.0 -

If rent is due on 23 April, that means your periods run 23rd-22nd.
You can send the notice in at any time up to and including 22 April, but note that is a Saturday you will want to post a few days before to ensure it is received on time. As long as you meet that deadline your last day in the property will be 22 May.
As long as you don't forget there's no benefit to doing it much before 22 April as you can't end the tenancy before 22 May. That just gives the landlord more notice of your intentions and more time to annoy you with requests to bring new tenants round for viewings.0 -
Not necessarily. That assume rent is due on the 1st day of each period, which is usually, but not always, the case.gingercordial wrote: »If rent is due on 23 April, that means your periods run 23rd-22nd.
.
What dates did your fixed term start and end?

It ended on 13 june for some reason -forgot why now but at the time it was to even up the books/days somehow- in 2015. I can't remember when the 2016 one ended becuase they never sent me a copy. I rang a couple times and they kept saying they couldnt get hold of the landlord to sign it so I never ended up getting one and it went on to rolling contract then so Im not sure. The agency has changed hands since too and from all the questions they asked me about the property when they came to inspect it seems there was little to no communication with the previous agency.0 -
Did you actually sign the 2016 contract? What was the term - 12 months?cashmonger wrote: »It ended on 13 june for some reason -forgot why now but at the time it was to even up the books/days somehow- in 2015. I can't remember when the 2016 one ended becuase they never sent me a copy.
If so, then it is not due to end till 13th June 2017, and you can't end the tenancy till then.
If you did NOT sign a 2016 contract, then your tenancy went periodic on 14th June 2016, with periods running from 14th to 13th of each month.
As explained previously, the date rent is paid is not relevant.0 -
No I didnt sign one for 2016 onward.
Ok so I thought that the new rent of £750 would mean that if it is to come into effect on May1 as they put in the section 13 that I would actually pay that new amount on 23 april?
So that means I would need to give notice in the next couple of days in order to not pay the new rent or when?
I think I should ask them about this shouldnt I to be sure. The avoiding having viewings is not that big a deal to not get my notice sorted out.
I want to avoid having to pay the new rent of 750 and will move out sooner rather than later if needs be.0 -
The other issue you have is that you are paying rent on 23rd, but it's unclear what period that rent covers.cashmonger wrote: »No I didnt sign one for 2016 onward.
so you were just trying to confuse us by saying " I can't remember when the 2016 one ended "??

If your periods start on 14th, the new rent will start from 14th.

No idea where the agent got the 1st from. I suspect that as they are new agents, they don't know what your periods are so just used the 1st.
So that means I would need to give notice in the next couple of days in order to not pay the new rent or when?
If you give notice on or before the 14th April, you'll end the tenancy on 13th May.

So your payment on 23 April (at the existing amount) will cover
* 14th April - 13th May? or
* 14th May - 13th June? or
* 23rd April - 22nd May?
If you've given notice and will be ending the tenancy on 13th May, then you need to calculate the daily rate of your rent, count the number of days rent you will owe, to 13th May, and pay that.0 -

Yes this is what I was getting at, that I don't know what it is covering so wasn't sure when to end the tenancy. I guess I will only know once I discuss it with them however I doubt they will know either but if they look on my previous contracts they should be able to see. But in that case they have no more information than I do- thought they may have the 2015-2016 tenancy agreement which I never received.
Best to contact them I think to get it sorted.0
