Still getting calls today from MBNA, who seem to be ignoring my letter asking for contact only in writing. I've been not answering calls while I waited for the letter to filter to whoever needs to see it, but they're not giving up. Think I'll have to bite the bullet and answer the next one, and have them put a note on the account.
I would just tell them that you would like to withdraw your consent for them using your phone no's in line with the new general data protection regulations that came into force last month & see what happens.
Follow this up with a letter or secure message as well.

Of course you could answer the next call and remind them of your instruction to remove your mobile/house number from their records... or, simply, block their number. You've told them to contact only in writing, so there is no need to speak with them unless you want to.0 -
Recently done CCA requests and have had two replies today from PRA GROUP stating that
" they are awaiting further documents but they currently deem this debt as unenforceable which means we are not able to take court or further enforcement action against us to recover the outstanding balance".
Please be advised this does not mean that the debt has been written off despite being unenforceable etc.
Any idea what I should do now?

Nothing for now, it goes unenforceable automatically until the paperwork is supplied, however long that may be.

Okay, usually most reasonable creditors will have put your account on hold and frozen all interest and charges. But whether they do or not is just a temporary problem, because eventually your account/s will be defaulted and then interest and charges stop. A few of ours charged interest for around 6 months + others stopped from the beginning - it's just how things go sometimes. As for the calls, just block their numbers and send letters telling them they only have permission to contact you in writing. Stick at it.. it will get better0 -

As Sourcrates has advised... its now up to you whether you choose to continue to pay them or not. I'm in the same position with regards to 3 of my outstanding debts and I've not paid PRA anything for 11 months.. have set what I would have paid them aside and will eventually offer F&Fs. They've been in touch in the last few weeks offering me a 10% discount if I pay in full, but I'm holding out for more substantial discounts. So its a bit of a game and rather depends on your own resolve and how comfortable/confident you feel about playing the 'long game'.0 -
Hey all!
My first post. Been a very stressful and traumatic 12 months for me, but just wanted to say hi as I'm slowly working my way through all 205 pages of this thread.
We had a lot of debt £30k - Then I developed a gambling problem trying to get out of it and landed us in £50k of debt total. Hate myself for it and what it is doing to my marriage, I considered some very stupid things....but coming clean about my hidden problem felt amazng and not even thought about gambling since that day 6 months ago.
Hoping a DMP is going to be the answer although technically I can afford all credit card payments at the moment, it's just leaving us so tight (after food shopping we have £40 a week which has to try and cover any unexpected amounts - Car repairs/tyres/birthdays etc)
I earn £60k a year and currently pay £1250 a month on credit cards (minimum payments) and loan, would be ideal if I could get this down to £800. I've exhausted all options of balance transfers, debt consolidation loans etc.
Am I wasting my time or should I be grateful for having £40 a week spare for a family of 4...0 -

I think we all thought we could afford our credit payments until the point we realised we needed help. I, for one, was definitely making full payments to my loans and credit cards right up to the point I admitted I was working and living just to pay the creditors and there was nothing left for us to live. Everything we did was done on credit
You are definitely not wasting your time. When you work out your budget make sure you put the maximum you are allowed for each category and don't try and skimp and save money to give more to creditors. It's important you are realistic or you are more likely to fail in your DMP if things are still too tight for you to live reasonably comfortably.

Well done for coming clean and facing up to your debt. As others have suggested, working out a budget is a really good idea as all DMP Companies will look very closely at your affordability and will look to take every penny of your disposable income so its essential you document everything.
7 years ago I was in a DMP with close to 50k of debt. 2 years or so ago I switched to direct payments with my creditors and will be debt free 6 months..
I have a budget template you might find useful. Its one I've used with my creditors to confirm disposable income (and therefore agree monthly payments)
