    Hi, wondering if anyone can advise.
    I have an old Egg Loan on my DMP, been defaulted years ago and it has fallen off my credit file now.


    I still owe £5k and asked Cabot for CCA They have come back acknowledging it is unenforceable. I'm with Stepchange and wondered if I should ignore the debt now.

    Thanks, both. I've today received a very pleasant letter from Barclaycard, acknowledging my letter and saying they won't charge any further fees or interest for 30 days, and they won't contact me during that time except for formal notices they have to issue under the CCA. :) So I feel like I've finally made a small increment of progress.



    Just had a text message from Halifax reminding me I don't have a direct debit in place, and I had a letter yesterday from MBNA telling me my payment is late, but hopefully they will catch up soon. No contact of any kind from M&S as yet. Maybe no news is good news as they've received the letter and are preparing to write back.

    (1) My question is does a CCA request have to be in the exact name & address it was originally taken?



    (2) other payday loans have not bothered to respond, I have copies of the letters I sent but no proof of postage, do I send new CCA requests just in case they may claim they never received the first ones?


    (3) Littlewoods they only responded to say they have now sold my account to Lowell & I have now noticed the entire account has disappeared from all 3 credit reference agencies, it was never defaulted but always had AR markings every month for many years. Is it normal that the record has vanished?

    Answers :


    (1) Wont make any difference to enforcability.


    (2) Your original request still stands and will continue to do so, the account cannot be enforced until they comply, no matter how long that may be (you could send reminder to them).


    (3) Original paperwork is held by Littlewoods anyway, so that point in mute, sometimes entire entries do disappear from view, it could be because a dispute has been registered (CCA request) or just an anomaly of some kind.


    Don`t be surprised if it reappears under Lowell's name.

    Unless you have a very strong desire to add to Cabot's profit margin`s, I would put this one to the bottom of the pile, quietly forget about it, and concentrate on the enforceable debts you have (if any).

    I just changed the amount owed to zero on stepchange. They didn't query it just rearranged the payments to everyone else.
    (Edited to add that Crabot actually put in writing that it was ue and that they wouldn't be pursuing it).

    Hi all,I have not been on here for a while due to being in hospital for server depression but that's a different story,been on a dmp with sc for over a year everyone of my creditors have excepted my plan apart from Halix they stop interest for a while then start adding it again so I phone them and ask why it's not been put in default yet and not sold on they won't give me a straight answer it's there anything at all I can do as I can't face bailiffs or court I am at my wits end and sinking fast

    Forget courts, forget bailiffs, youve been watching too much television, you could stop paying them, they will soon default it, and get rid of it.

    Or you can go the written complaint route, that may be productive, do not phone them though, the call handler has no discretion to do anything, and knows even less about your situation.

    Written complaints get straight to the organ grinder.
