Can I ask how people on dmp!!!8217;s are getting on with interest being added? Barclays (loan & overdraft with) appear to have a policy of not stopping interest, this can!!!8217;t be the case surely? Also can I ask those with experience of UE debts did you write back (after CCA) and state you believe it!!!8217;s ue or did you take no further action and did they simply keep piling on the interest? Thank you so glad I found this forum!
BC do not stop interest if you are paying 1% or more of the amount due each month.... so for example if you owe £12,000 to BC and your monthly payment is £120 or more they will continue to add interest. However, if your monthly payment is £119.... no interest. Go figure :mad: The only way to deal with BC is to either not pay at all or drop to token £1 payments until the account is defaulted. They are terrible to deal with in my opinion.
Regarding UE - I just stopped all contact with mine, and the DCA kept writing and asking us to pay. I ignored them. They wrote with ever reducing settlement figures. They knew it was UE, but didn't ever admit it. The only time I responded was when they offered me to settle at 10% of the balance :TDFW Nerd No. 1484 LBM 07/01/15 Debt was £95k :eek: Now debt free and happy :j0 -

i have 3 UE debts at the minute. One came back and said it was UE so I sent them a well I'm not paying you letter and not heard anything since. One I haven't heard anything back from them since the we are looking for the cca letter was received in September so i stopped paying them.
The third was more awkward as they were sure it was enforceable and this has finally been settled, for now anyway. I did write to them to say it was UE but not why, I followed AAD'd letter templates hence why I paid the £10 to join. All mine had stopped interest ages ago as my dmp started in 2013.

SC have sent me 3 application packs for a Barclays basic account, none of which I requested. I spoke to SC who said Barclays will not use the right of offset if you have debts with them & open a basic account. I don't trust them either! I'm a bit suspicious of SC pushing this too.0

Both accounts were less than 2 years old.

Never any harm for the sake of the £10 it will cost me.is there a guide anywhere on the forum telling me what I need to do? I have had a quick read and am just about clear on most things however some things aren’t clear:
Some credit agreements were done online where I ticked a box to say I agreed. Is that classed as my signature for CCA purposes?
Are payday lenders included in this? (Specifically pounds to pocket)
What happens if the agreements are unenforceable? Do they just sit on my credit file for ever as Unsatisfied/unsettled debts or are they struck off/marked as unenforceable?0 -

Hi,
I can't answer all your questions but can say a cca request is a £1, a sar request is £10 per creditor. You need to read up about the pre/post 2007 requirements for what has to be included in the documentation.
I'm not sure how long you have been on a dmp? Have your debts all defaulted? If so then they will still fall off 6 years from default date, however if they are being marked dm/ap then I am not sure what happens long term because these don't fall off till 6 years after the debt is settled and the creditors will continue to mark your credit file even if the account is considered UE as the debt is still owed only they can't legally enforce it.

I've got 2 (same creditor) who can't supply CCAs from 2012 & 2015 :T Needless to say, no payments and no communications with them now. They will either find the CCAs or the account will eventually become statute barred. The clock is ticking along nicely... well over 18 months now since I requested the CCAs and they just keep writing and apologising they can't find themDFW Nerd No. 1484 LBM 07/01/15 Debt was £95k :eek: Now debt free and happy :j0
