  • I'd do a land registry search, ask for the official copy register entries and the title plan. Each cost £3, and I think it's money well spent in this case. There may be some unregistered land bordering your MIL's house and then they'd find it difficult to show that this land is included in the land they are managing pursuant to whatever contract they are claiming gives them rights.

    So....An update. I spoke to the school yesterday and ended up getting a callback from the facilities manager who confirmed that he has the contract with UK CPM. However, he was considerably less than helpful and the conversation did not go particularly well....I certainly felt like I was just another in a long line of sob-stories to him, he even said as much.

    It was actually pointless him calling back as he just reiterating the same point 'the signs are there, you should have checked them'. Even said that in the case of medical emergency, we should call the school immediately if we had to park there. Probably would be the last thing on my wife's mind in that scenario.

    We have a case with medical and social care records that can back it up, plus some historical precedent. I called back and complained about the guy's attitude... At least the school office were quite sympathetic and said they would see if there was anything else they could do. Wifey and MIL might pop in later in the week to discuss things further with the head.

    I'd write to the school head asking, in the event that this case goes to court (and UKCPM are becoming increasingly litigious), would it be the head him/herself you will be asking the court to require their attendance, if not, to whom should the court address the requirement? Ask for a list of dates over the next six months when the attendee is not available, so you can provide the court with these in advance.

    A bit of bluff, but if they're going to be playing silly beggars and being difficult about this, let them have some back. This forum is all about fighting back, not meekly surrendering to 'authority'. Who the F does that facility manager think he is?

    The facilities manager should really be looking for a new job as he is pretty hopeless

    However could the facilities manager be on commission ??? he has the contract with UK CPM after all ??

    The LEA will be subject to the Freedom of Information Act.
    In addition to the meeting with the head, write to the LEA (copy to school) with a FOI request:
    1. a copy of the parking contract to show who the parties to it are
    2. details of what payment(s) the LEA receives as a result of the contract, or what it pays the PPC pursuant to the contract
    3. details of how many complaints the school/LEA has received about the PPC's practices at the school, and copies of such complaints (redacted for confidentiality/Data Protection)
    4. Copy Minutes of Meetings/internal email communications/written communications between the school and the LEA about entering into parking contract, the operation of the contract, and any complaints received about the PPC's operations.
    5. All correspondence between the PPC and the school/LEA concerning entering into, and the operation of, the parking contract
    6. All correspondence, internal/external, regarding how the LEA/school will deal with unfair PCNs issued by the PPC
    7. You might ask for this information in relation to all schools in the LEA's area ,but this might be a bit OTT

    In my experience, local authorities HATE FOI requests and this may make them cave in.
