myparkingcharge

The driver of a car received one of the infamous myparkingcharges.co.uk notifications on their window a couple of days ago hxxpp i.imgur.com/sKK1bTl.jpg. The driver was not the registered keeper. The driver has read through the newbies guide and several posts relating to this and is up for the fight! However, a couple of things they are not too sure of and would appreciate any help.

First of all, after reading all the threads on here the driver is assuming that the notification would not be classed as a NTD, is that correct? If so, then I believe the RK should expect to receive a NtK within 14 days, any later and it's not valid. The driver and keeper are waiting and watching!

There was no sign on the entrance into the car park, after reading some of the posts they wonder if the PPC needed to display one on the entrance? (hxxp i.imgur.com/oviXqxh.jpg)

There were signs up but the driver assumed that the business they were visiting had rights for their customers to use this car park as there is no parking facilities on that business that the driver could see, the business was adjacent to the car park, off the same slip road. I notice that it says the PCN is payable within 28 days (I think, even zooming in on the camera I couldn't clearly make this out). Would that indicate that the notice actually was an NTD??? Also the sign says use of CCTV/ANPR. the driver didn't notice any cameras and if there was why would they issue the notice?

I hope it's OK to create a new thread on this matter. I have read and reread the newbies thread, all of the threads regarding myparkingcharge and many of the threads on pepipoo and theparkingprankster about this, I would just some help and guidance to assist the driver and keeper regarding this matter.

    for a windscreen ticket, the keeper would receive a postal NTK between day 29 and day 56 if the PPC wishes to invoke POFA2012

    the 14 day rule is where no ticket was issued on the day (like with anpr camera enforcement)

    Thanks RedX, I thought though that it was established (and confirmed by the DVLA) that the myparkingcharge leaflet didn't amount to a NtD and so the PPC (VCS) need to send out a NtK within 14 days. Have I misunderstood that?

    in my opinion , if a windscreen note is left , then its an NTD

    there is no set format for an NTD as such

    So the signs are saying it is parking for only 2 retailers, not for the other business, but it is vague on what the requirements are ''IF a permit/ticket is needed''?!

    Sounds like a parking goon watched the drier walk to the third business, without stopping the driver to talk to them and mitigate any loss. As per VCS v Ibbotson, the famous toothbrush case!

    As for the question of ''is this a NTD'' there are mixed opinions and the DVLA has raised a concern about this 'ticket' with the IPC but that will go absolutely nowhere.

    Thanks very much CM! Yes, that is exactly what happened. The driver noticed a couple of people near the vehicle when they returned but nobody who looked like a parking officer, nobody in any form of uniform.

    As a layman, can I just check my understanding of that case is right though, that the judge threw it out because the contract between VCS and Wickes didn't explicitly state they had the right to issue proceedings (I presume that means take them to court!)? I would imagine now that VCS have amended their contracts since!

    Yes but the Judgment also said that VCS had a duty to mitigate loss...and although since then, ParkingEye v Beavis found that a parking charge does not have to equate to a loss or GPEOL, it still has to be commercially justified and not disproportionate under all the circumstances.

    Great, thanks for that. Still rather hoping this will go away before a defence is required and VCS mess up with the admin. Should they just sit tight until a NtK arrives then send the IPC letter?

    that is what the NEWBIES sticky thread tells them to do , yes

    and any hopes of this "going away" are far fetched , once they have a victim on the hook they are unlikely to let it go , they dont have a policy of "catch and release" , they have one of "entrapment"

    This is the drivers first ever PCN in over 25 years motoring and they are quite prepared to go to court. If they lose, they lose, at least it will have cost the PPC more than they would recover :-)

    agreed, bear in mind it is unlikely to be their last since the parking companies have massively increased this sc@m since 2012 , so much so that it was debated in parliament only 2 days ago , even some of those MP`s have similar issues

    everybody needs to be vigilant and never assume they have the right to park or stop anywhere at all that may be private land , as these p@rasites are everywhere
