Parking Eye Barnet Hospital

Hi,

I was hoping to get some advice. i have read through the newbies thread and I'm still confused on how to appeal my PCN.

I am pregnant and had a bit of a scare. my mum took me to hospital and parked in Blue badge holders bay, with my car. We have parked in the blue badge holders bay once before in the same hospital and never received a PCN. I got a letter showing my car entering and leaving the car park. Ive since researched online and it states on Barnet hospitals website that you must inform them that you are parking in a blue badge bay. Ive never notified them previously and never received a PCN.

my question is do i appeal on the grounds that we have a blue badge and i never received a fine before or do i appeal it with the template provided here? (i don't know which one as there are so many)

    So search this forum for 'Barnet NHS Trust complaint'. Use the forum, search it! Or how about simply going on the NHS Trust website and finding the contact us email for complaints...and write your own.

    Then also send the usual appeal to PE (online) with a copy of the Badge. Or are you saying you used a disabled bay due to being pregnant?

    Thanks for your response. I haves spoken to the PALS in Barnet who have forwarded a template that I need to fill in and email them. The lady I spoke to advised that they should be able to cancel the fine and will notify PE so I don't need to appeal to them as well.

    My mother is the blue badge holder, she takes me to all my appointments. Not because of pregnancy.

    So do I not mention in my appeal that my mother was driving? how am I going to write my appeal? I am the registered keeper of the car but my mother has a blue badge... how do I word this appeal?

    You must not give away the driver's identity.

    It is not a fine.

    Simply use the BPA template in blue from the Sticky thread for NEWBIES. Do not miss the appeal deadline and do not edit the template which you send as keeper. (Keeper on the day of the incident who may or may not be the registered keeper.)
    You can add that one of the occupants of the car was a BB holder and include a copy of the badge, but it probably won't make any difference. Make sure you don't reveal the driver's identity if you include the BB information.
    The BB scheme doesn't apply on private land anyway, but the parking companies just don't care. They only want money.

    I challenge this 'PCN' as keeper of the car.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.

    I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    Yours faithfully"

    Is this the template you are referring to? This template does not refer to my situation with the blue badge?

    So do I not appeal to PALS?

    yes use the blue text template for your online PE appeal

    add an EXTRA line stating that an occupant of the vehicle is a blue badge holder and qualifies under the EA2010 and enclose a scan or photo of that blue badge

    DO NOT REVEAL who was driving

    and you are COMPLAINING to PALS, not appealing

    This is what I will be sending to PALS. I hope i have covered everything. I have used sections from various threads.

    As registered keeper of the car, I have received what I believe to be a very unfair parking charge from Parking Eye at Barnet Hospital.
    I was seeking urgent medical attention for a genuine pregnancy scare. Most of my appointments are in Chase Farm hospital however when I have any problems I must visit Barnet Hospital as Chase farm not longer have a maternity unit. My mother and husband always come with me to all my appointments. When we have to visit Barnet Hospital we never find parking in a blue badge bay and always end up driving around for at least 10 minutes to try and find somewhere to park. In the end my car will be parked in a normal bay and paid for using the automated system on my phone, as there is never a blue badge bay to park in.
    On Friday 17th February. I was not well and spoke to Triage who advised me to make my way down to them immediately. As you can imagine this was an awful feeling and I was petrified for my baby’s well being. For the first time the car park was pretty much empty and we parked in a Blue Badge Bay and displayed the blue badge. I was in hospital with for almost 2 hours. I eventually got the all clear and I left.
    A few weeks later I received a parking fine. I was not aware that the vehicle must be registered in reception. As we have never been able to park in a blue badge bay previously due to the fact that there simply not enough blue badge bays in the hospital car park.
    I can provide you with proof of every visit that we have made and paid a minimum of £3.20. I also have noticed that in the triage building there is a sign that says in you wish to park for more than 4 hours with a blue badge that you must notify reception. I thought this would be the case only if you wish to park for more than 4 hours. I was not aware that you need to register the car, as my car has never been parked in a blue badge bay before. On this occasion I was not well at all and had an awful scare that I was rushing to get to the triage midwife sections asap. My car was parked and displayed the blue badge and I rushed off to see a midwife urgently.

    I am disappointed that the NHS Trust is breaching Government policy by allowing a private firm like Parking Eye to profit from PCNs particularly in instances where patients are seeking vital treatment or urgent medical care. Firms like Parking Eye are clearly incentivised to issue charges as their earnings are little other than penalty income. Which is wrong and against the will of Parliament, please reference the below.

    I understand as per the terms between the NHS Trust and Parking Eye, Parking Eye is required to consider genuine emergency cases like this. Based on the reasoning’s outlined above, I respectfully request your support in cancelling the charges in this instance.

    SEEMS OK TO ME , except you have used the F word (and the P word but that was in context so ok)

    and a lay person would use the F word

    so I would definitely send that to PALS but double check that it does not reveal who was driving

    and do the online appeal on the PE website within 28 days of the postal pcn, adding an extra line about the BB and a scan of that BB too , if PALS do not cancel it

    if they DO cancel it , add that as a further EXTRA LINE to the online appeal , stating that the trust have informed you that the pcn has been cancelled (as well as the BB line)

    it is over when PE send you a cancellation notice , NOT BEFORE, so dont miss the appeal deadline whilst awaiting PALS

    F word, meaning fine. Whats the P word??

    I have read it so many times and changed the wording trying to not say who was driving. So I can send this to PAL and I can also send this to PE, but within 28 days? 10th March is when the 14 days discount period runs out. Should I wait until PALS gets back to me or send it to PE at the same time?
